Description

The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Mettler Toledo of Columbus Ohio for the purchase of a 2 Year Maintenance Contract Type C for Mass Comparators and Maintenance Service for the AX10005V under other than full and open competition by the authority of FAR subpart 13.106-(b): Only one responsible source and no other supplies or services will satisfy agency requirements. The Sole Source determination is based on the need for the Mass Comparators and the AX10005V to operate in accordance with the original equipment specifications from the manufacturer. The Mass Comparators and the AX10005V is a leading edge product for Mettler Toledo and no other company can supply certain proprietary parts or has the knowledge of proprietary aspects of the instrument in order to be able to service the Mass Comparators and the AX10005V. Mettler Toledo is the designer and manufacturer of the specified, high- precision mass comparators. Only Mettler Toledo staff are trained and authorized to service, maintain and repair these particular systems. Technical staff from other branches of Mettler-Toledo, as well as non Mettler Toledo service people is not qualified or authorized to perform these services on this equipment. The resulting Purchase Order will be for two years. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor’s commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 333997, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 1:00 p.m. (EST) on May 25, 2009. Inquiries will only be accepted via email to janet.lamb@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
