There are no known substitutes available for this service.Restricted to the following source: Contractor: RCDS Contractors Inc.Contractor POC & phone number: Ricardo Cordova (480) 941-7224Contractor Address: 9965 N. 95TH STREETSUITE 115SCOTTSDALE, AZ 85258-4594Dealer/Rep (if applicable): _N/A____________________Dealer/Rep Address/phone number: __N/A_______[X] The requested service represents the requirements of the Government.(1) AGENCY AND CONTRACTING ACTIVITY: Southern Arizona VA Health Care System (SAVAHCS) Contracting Section (678/9-90C)3601 S. 6th AvenueTucson, AZ 85723 (2) NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:In accordance with IL 049-07-08, Veterans first Contracting Program, dated 6-19-07, and Public Law 109-461, Veterans Benefits, Health Care and Information Technology Act of 2206, effective 6-20-07, the Southern AZ VA Health Care System, (SAVAHCS) is conducting a sole source Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside procurement for construction of project No. 678-10-101, Emergency Power Distribution Phase III with RCDS Contractors Inc and anticipate to negotiate a firm fixed price award.(3) (a) A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCYS NEED: Electrical Construction: Contractor shall furnish material, equipment, supervision and labor for all the work on a 208V, and 480V emergency power system. This includes general construction, excavation, demolition, alternation, electrical, controls, architectural, civil and mechanical work, utility systems, temporary power, testing, start-up, necessary removal of existing equipment, locating and relocating equipment and other items. New equipment work includes branch and distribution panels, pad mount transformer, electrical switchboards, underground duct-banks, power cable and conduit, abandonment, demolition, removal and disposal of existing equipment and materials. Where possible work is allowed on only one system at a time and only the system being worked on can be out of service. Keep outages on the critical, life safety and equipment branches separate. Costs proposal is to be organized on a line item activity basis. List costs for each bid item deduct. Bid documents to include a cost schedule of values, submittal register, infection control plan, construction schedule, a demolition, installation, phasing and connection sequencing plan that minimizes interference with hospital operations during normal hours, keeps patient areas energized and minimize outages and outage time. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system.N/A[X ] Authorized by statute Identify Statute and describe why this authority is being used for this acquisition.Public Law 109-461, Veterans Benefits, Health Care and Information Technology Act of 2006, (effective 6-20-07), 38 U.S.C. 8127 permits the Department of Veterans Affairs to sole source procurements >$100,000 and <$5 million to responsible SDVOSBs and/or VOSBs, if at a fair and reasonable price. Currently RCDS Contractors Inc. is the only known local SDVOSB construction firm who is technically capable/acceptable for installing and constructing complex electrical systems for Tucsons SAVAHCS facility. RCDS Contractors Inc. has/is successfully performing on several projects here at SAVAHCS. Phase I of this project was awarded to Candelaria Corp, who is not eligle for award under this acquisition due to their status as an 8(a) business. Phase II of this project was awarded to RCDS and is 43% complete. Phase III is a continuation of phase I & II and RCDS has an intricate knowledge of the existing systems and what will be required to accomplish this project successfully and on time. It is imperative that the contractor is able to coordinate and understand how the electrical systems are to be configured and interrelate to other electrical portions of the systems. RCDSs knowledge of the existing system and with what they are installing currently play a large part in a successful project. It would take a considerable amount of additional time for a new contractor to understand the layout of the electrical system and how the systems are intergraded into the entire SAVAHCS electrical systems. The additional time required by an alternate contractor will slow the project and add additional costs. It is therefore in the best interest of the government to award Phase III of the project to RCDS.(6) A DESCRIPTION OF EFFORTS MADE TO ENSURE OFFERS ARE SOLICITED FOM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED IN FEDBIZOPPS AS REQUIRED BY FAR Subpart 5.2, AND IF NOT, WHICH EXCEPTION UNDER FAR 5.202 APPLIES.No efforts were made to solicit offers from other potential sources since Public Law 109-461 permits VA to reach out to SDVOSB firm with which we wish to contract. Synopsis is not required in accordance with FAR 5.202(a)(4).(7) DETERMINE WHY YOU BELIEVE THE ANTICIPATED COST WILL BE FAIR AND REASONABLE TO AID THE CONTRACTING OFFICER IN MAKING THIS DETERMINATION: (IAW FAR Part 15.405)It is anticipated to award this acquisition as a firm fixed price contract. The A&E Firm that designed the project (GLHN of Tucson) has provided a project estimate and will be used in determining the governments estimate. The government estimate will be the bases for any potential negotiations. RCDS was previously awarded Phase II of this project under a fair and reasonable price and the negotiated/acceptable proposal received may be used in evaluating any proposal received in response to this acquisition. This will help in indentifying a baseline in which to compare prices offered. The acceptable proposal received under Phase I may also be used in determining a fair and reasonable price. (8) A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED:Additional market research consisted of searching the following various databases:VETBIZ.gov, Dun & Bradstreet, CCR.gov, ORCA, EPLS as well as other debarred web sitesIt is in the governments best interest to utilize PL 109-461 and pursue a sole-source award to RCDS Contractors Inc..(9) ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION.Far 6-302-5 Authorized or Required by Statute(a)Authority. (1) Citations: 10 U.S.C 2034(c)(5) (2) Full and Open Competition need not be provided for when (i) A statute expressly authorizes Statute P.L 109-461 Sec. 502 as codified in 38 U.S.C 8127. Sole Source Contracts for Contracts above Simplified Acquisition Threshold. For purposes of meeting the goals under subsection (a), and in accordance with this section, a contracting officer of the Department may award a contract to a small business concern owned and controlled by veterans using procedures other than competitive procedures if --such concern is determined to be a responsible source with respect to performance of such contract opportunity. --The anticipated award price of the contract (including options) will exceed the simplified acquisition threshold (as defined in section 4 of the Office of Federal Procurement Policy Act (41 U.S.C 403)) but will not exceed $5,000,000; and --The contracting officer has validated that the contractor is registered and certified in the VA VETBIZ.gov data base and qualifies as small in accordance with federal small business size standards for the applicable North American Industry Classification System (NAICS) code assigned to the procurement.The estimated magnitude of $1M to $2M within the limits for the sole source award authority.
