- DEPARTMENT OF VETERANS AFFAIRSVAMC IOWA CITY, IOWA #636A8 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION JUSTIFICATION In accordance with the requirements of FAR 6.302-5, IL 049-07-08, and 38 U.S.C. 8127, I submit the following justifications: 1.The action being approved is entitled Installation of Pressure Reducing Valve. The project is for construction to install a new Pressure Reducing Valve (PRV) to lower the steam pressure to the Air Handling Unit and the heat exchanger. The current pressure is 50psi and the operating pressure needs to be between 12 and 15psi. The new PRV is to be installed in Rm 121 of Building 2 at the Iowa City VAMC, in Iowa City, IA. 2.The Medical Center needs the current PRV replaced to lower the current psi to allow AC technicians to regulate temperature. The estimated total value of the project is less than $25,000. 3.The statutory authority permitting other than full and open competition is FAR 6.302-5 --Authorized or Required by Statute, 38 U.S.C. 8127, and IL 049-07-08 Veterans First Contracting Program. 4.There is a local Service-Disabled Veteran Owned Small Business registered in the VetBiz.gov database that has been identified through market research as capable of fulfilling this requirement and concurrence has been obtained from Engineering. Based on the Office of the General Counsels interpretation as provided by Dennis Foley, AWG Services, LLC meets the requirements of FAR 6.302-5, 38 U.S.C. 8127 and IL 049-07-08 for an other than competitive sole source award. 5.Based on the proposed procurement approach, FAR 5.202(a)(4) applies and a synopsis will not be issued. 6.It is determined based on past activity and performance that the anticipated cost to the Government will be fair and reasonable. 7.Market research was conducted resulting in the identification of a SDVOSB that was subsequently determined as capable completing the project. 8.There are no other facts supporting the use of other than full and open competition. 9.There have been no sources expressing an interest in the acquisition. 10.The agency will take no actions to remove or overcome barriers to competition for this requirement based on the guidance of FAR 6.302-5 --Authorized or Required by Statute, 38 U.S.C. 8127, and IL 049-07-08 Veterans First Contracting Program and the interpretation of the statute by the Office of General Counsel. APPROVAL Based on the foregoing findings, I hereby determine, within the meaning of FAR 6.302-5 and in accordance with FAR 6.304(a)(2) and VAAR 806.304 and the Federal Property and Administrative Services Act of 1949 that: a.It is in the best interest of the Iowa City, VA Medical Center to acquire the construction services for project entitled Installation of Pressure Reducing Valve, from AWG Services, LLC. Upon the basis of these justifications, I hereby authorize the sole source negotiation for this procurement and by signing this document certify that the justification is accurate and complete to the best of my, the contracting officers knowledge and belief. ________________________________________________________ Contracting OfficerDate
