- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Identification of the Agency and the Contracting Activity: Department of Veterans Affairs, Great Lakes Acquisition Center, 5000 W National Avenue Bldg 5, Milwaukee WI 53295 2.Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the indefinite delivery indefinite quantity (IDIQ) job order contract (JOC) at the North Chicago VA Hospital, North Chicago, Illinois. 3.A description of supplies/services required: VA North Chicago has an immediate requirement for General Construction Services for maintenance, repair, and Minor construction projects, to include electrical, mechanical & plumbing services. Jobs shall be issued as Task Orders for individual projects. Contract shall be for 1 year with 2 option years. Individual Task Orders shall not exceed $500,000.00 and shall not be less then $2,000.00. The minimum guaranteed value of the contract is $100,000.00 for base year and $100,000.00 for each option year. Maximum for the entire contract shall not exceed $4,999,999.00 4.Statutory authority permitting other than full and open competition: FAR 6.302-5 FAR 6.302-5 is "Authorized or required by statute." 41 U.S.C. 253(c)(5) allows for other than full and open competition. It is 38 U.S.C. 8127 (P.L. 109-461) that gives VA this authority. 5.Facilities Unique Qualifications: Under the authority of PL 109-461, an SDVOSB firm has been identified by the COTR who is qualified and experienced to perform this work. It is anticipated that a fair and reasonable price will be obtained for this work. Public Law 109-461, Veterans Benefits, Health Care and Information Technology Act of 2006 authorizes sole source procurements to Service Disabled Veteran Owned Small Business 6.Efforts made to ensure that offers are solicited from as many potential sources as is practicable: N/A - Public Law 109-461 allows sole source procurements to SDVOSB firms. 7. A description of the market research conducted or statement why market research was not conducted: CPMA, Inc is registered in VetBiz as a SDVOSB firm and therefore is eligible for sole source award in accordance with the requirements in Public Law 109-461 8.
