- The National Labor Relations Board intends to award a sole source contract to Harvey A. Holzman, pursuant to 10U.S.C. 2304(c)(1). The NLRB Agency is required to defend cases brought against it under Title VII of the Civil Rights Act of 1964, and other civil rights legislation, and Harvey Holzman, the Attorney-contractor, has been active in a series of cases brought by the plaintiff/complainant in federal courts and the Equal Employment Opportunity Commission. Retaining Mr. Holzman this Fiscal Year will authorize him to continue to provide crucial legal services on the Agency’s behalf. This contract must be awarded to the Attorney-Contractor in order to ensure proper continuity of functions and legal services necessary to staff these cases. Work on the cases is continuous and is expected to continue into and through the end of Fiscal Year 2009. Attorney-contractor is to provide continued legal services required to assist the Justice Department Attorneys in the litigation of these cases. Weber v. Battista, Case No. 1:01CV00862 (D.D.C.), appeal docketed as No. 09-5169 (D.C. Cir.); and Weber v. Liebman, EEOC No. 570-2008-00025X (Agency No HDQ 03-12). This is not a formal solicitation. This synopsis is not considered a Request for Quotation or Proposal. No solicitation document is available and telephone requests will not be honored. No contract will be awarded on the basis of offers received in response to this notice. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government.
