Description

MFR Sole Source Justification Need List for Titus Software DISA/DITCO, intends to issue a sole source contract to A C T S Corporation, 609 Lake Vista Dr., Forest, VA 24551-1911. This acquisition is for the renewal of Titus Software Maintenance. The software being maintained is proprietary and protected by copyright laws. No third party maintenance is authorized. Period of performance has one base year (10 May 2009 - 9 May 2010) and four (4) one year options. The statutory authority for other than full and open competition is 10 U.S.C. 2304 (c)(1), FAR Subpart 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. See the attached "Needs List" spreadsheet for specific product requirements. Interested firms may identify their interest and capability to respond to the requirement by submitting clear evidence of their capability to provide/perform. The resultant contract will be a firm fixed price purchase order. This is a small business set aside. The NAICS code is 541512 for this procurement. The justification detailing the government's essential need for Titus Software Maintenance is attached. This notice of intent is not a request for competitive proposals. All responses must be received within 3 business days of publication of this synopsis to be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government.
