Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Identification of the Agency and Contracting Activity: Department of Veterans Affairs (VA), VISN 20, Roseburg Health Care System, 913 NW Garden Valley Blvd., Roseburg, OR 97470 2.Nature and/or description of the action being approved: Justification and approval for other than full and open competition was reviewed and approved by the OSDBU VA representative under Public Law 109-461. 3.A description of supplies/services required: The VA Health Care System in Roseburg Oregon has the need for mental health upgrades. This project is to prepare a mental health ward while the larger mental health ward is being renovated. This is a vital and immediate need and must meet with complex mental health requirements within the VA. Project name: Swing Space Renovation. The total value of this project is $1,202,000. 4.Statutory authority permitting other than full and open competition: FAR 6.302-5. FAR 6.302-5 is "authorized or required by statute." 41 U.S.C. 253 (5) allows for other than full and open competition. 38 U.S.C. 8127 (P.L. 106-461) gives the VA the authority to contract sole source with Service Disabled Veteran Owned Small Business (SDVOSB). 5.Facilities Unique Qualifications: Under the authority of Pl 109-461, an SDVOSB firm has been identified by the Contracting Officer. A fair and reasonable price was negotiated. Public Law 109-461 Veterans Benefits, Health Care and Information Technology Act of 2006 authorizes sole source procurements to Service Disabled Veteran Owned Small Business. 6.N/A - Public Law 109-461 allows sole source procurements. 7.Efforts were made to identify SDVOSBs that could work in the rural Southern Oregon area. KEVCON Enterprises is registered in VetBiz as an SDVOSB firm and is therefore eligible for sole source award in accordance with the requirements of the Public Law 109-461. 8.Other facts support the use of other than full and open competition: Public Law 109-461. 9.Actions to remove or overcome any barriers to competition: None 10.Certification: I certify that this justification is accurate and complete to the best of my knowledge.
