- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION CONTRACT FA2517-04-C-0005 PAFB CUSTODIAL SERVICE PART I: JUSTIFICATION I. CONTRACTING ACTIVITY 21 CONS/LGCAB, 580 Goodfellow Street, Peterson AFB, CO, 80914-1648 II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED The requirement is a modification to an existing contract, FA2517-04-C-0005. The action contemplates a firm fixed price contract modification, [Redacted] for one (1) month, for an estimated amount of $204,590.32. The estimated issue date of contract modification is 26 May 2009. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS 21 CE/CEOE ensures non-personal custodial services are performed at Peterson Air Force Base (PAFB), Colorado, in a manner that will maintain a satisfactory facility condition, present a clean, neat and professional appearance. The scope of custodial service covers approximately 1 million square feet of office space and over 100 facilities across PAFB. The service covers critical facilities such as the Child Development Center, Youth Center, HQ AFSPC Building 1 and HQ NORAD-U.S. NORTHCOM Building 2. 21 CE/CEOE is responsible for developing Appendix 1, Task and Frequency for PAFB custodial services. The firm fixed price contract modification will provide all management, supplies, equipment, transportation, and labor necessary to ensure non-personal custodial services are performed at Peterson Air Force Base (PAFB), Colorado, in a manner that will maintain a satisfactory facility condition, present a clean, neat and professional appearance. [Redacted] IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION Authority for this action is 6.302-2 -- Unusual and Compelling Urgency. "(1) An unusual and compelling urgency precludes full and open competition, and (2) Delay in award of a contract would result in serious injury, financial or other, to the Government." V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) 1. FAR 6.302-2 authority applies because of the unusual and compelling urgency, precludes full and open competition; delay in award of a contract would result in mission failure to the Government. 2. Background: Rocky Mountain Service System is the current contractor that provides custodial services to PAFB. The current contract's, FA2517-04-C-0005 performance period expires on 31 May 2009. The expiration date includes the six (6) month service extension that was initially exercised to ensure the PAFB custodial contract end date would fall in line with CMAFS custodial contract end date plus a one month extension. The contract modification is for the continued custodial service until such time the new solicitation for custodial service, FA2517-07-R-5001, is complete and a new contract is awarded; approximately one (1) month. This contract modification will ensure continued custodial support for all facilities on PAFB. 3. [Redacted] 4. Without the contract modification, to extend the current contract, custodial services will not be accomplished for an extended period of time. RMSS has provided scheduling continuity for all custodial needs for PAFB to include areas that require their personnel to have employee background checks such as the Child Development Center, Youth Center and other designated restricted area badge access such as HQ AFSPC Building 1 and HQ NORAD-U.S. NORTHCOM Building 2. Changing contractors at the end of this contract would potentially cause a lapse in mission to those areas that require employee background checks and restricted area badge access. The contract modification, to extend the current contract period will allow continued custodial service for PAFB. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE The contracting officer determined that the proposed contract action is exempt from FAR 5.2 under the exception 5.202(a)(2). "This action is made under the conditions described in FAR 6.302-2 and the Government would be seriously injured if the agency complies with the time periods specified in FAR 5.203." Every effort was made on the new solicitation to ensure all eligible HUBZone firms were given an opportunity to propose on the new requirement under solicitation FA2517-07-R-5001. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The table below details the Independent Government Cost Estimate (IGCE) amounts. The Government Estimate was developed by Mr. Steve Sullivan of 21 CES by using RS Means and the Davis Inc. estimating systems. Extension period will consist of one (1) month. Any proposal received will be evaluated using techniques listed in FAR 15.404 and on that basis, a price fair and reasonableness determination will be made. It is anticipated that all costs associated with the contract modification will be fair and reasonable. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Market Research will not be conducted for this requirement. The urgency of the requirement, and short acquisition lead-time precludes Market Research. Market Research was conducted on the new solicitation for custodial services and is contained in the solicitation file FA2517-07-R-5001. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION The new solicitation provides for a complete performance work statement (PWS). X. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED The contract modification is for the continued custodial service until such time the new solicitation for custodial service, FA2517-07-R-5001, is complete and a new contract is awarded; approximately one (1) month. The contract modification will ensure continued custodial support for all facilities on PAFB. The Government's intent is to foster competition and has done so on the new solicitation. The planned award date for the new custodial service solicitation is 19 June 2009.
