- DESCRIPTION: RENEWAL OF MERCURY SOFTWARE LICENSES THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. FAR PART 13, SIMPLIFIED ACQUISITION PROCEDURES, ARE UTILIZED IN THIS PROCUEREMENT. THIS ANNOUCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEIGN REQUESTED, AND A WRITTEN SOLICITATION DOCUMENTS WILL NOT BE ISSUED. This solicitation is a request for quotation (RFQ). The solicitation document incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-32. The associated North American Industrial Classification System (NAICS) code for this procurement is 423430 with a size standard of 100 employees. This requirement is being competed on an unrestricted competitive basis among companies that are authorized by HP to sell the required software. APPLICABLE PROVISIONS AND CLAUSES: The Following FAR provisions and clauses apply to this solicitation: 52.212-1 52.212-3 52.212-4 52.212-5, including 52.222-50, 52.233-3 and 52.233-4 in paragraph (a) (1) and the following fill-ins in paragraph (b): 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-36, 52.232-33, 52.217-5 NIST seeks to procure a renewal of the following Mercury software licenses that are used by the NIST Office of the Chief Information Officer, Applications Systems Division. These licenses comply with applicable standards of Section 508 of the Rehabilitation Act of 1973, as Amended. NIST has already made a significant investment in the initial procurement of these licenses. If NIST were to replace the software licenses with a different type of licenses, NIST would also have to make an investment in new hardware and retrain its staff. Also, it is not feasible to potentially change licenses for a particular use every year since it would cause disruption and isn’t practical from an operational standpoint. Therefore, NIST is electing to renew its existing Mercury software licenses. Contract Line Item Numbers and associated quantities and descriptions of the license renewals can be found on the attached document Note: The exiting license number for the above Contract Line Item Numbers is: 1033-5596-2640 ADDENDUM TO PROVISION 52.212-1 - QUOTATION SUBMISSION INSTRUCTIONS This addendum replaces applicable paragraphs in provision 52.212-1. (b) Submission of quotations. Submit signed and dated quotations to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotations may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotations must include— (1) The solicitation number; (2) The name, address, and telephone number of the offeror; (3) Firm-fixed-price for each contract line item number, and any discount terms for those prices; (4) Acknowledgment of Solicitation Amendments, if any; (5) Evidence that the offeror is authorized by HP to sell renewal of the required licenses as specified in the contract line item numbers in this solicitation. (6) If the quotation is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotations that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration. All quotes shall be submitted so that they received not later than 3:00 PM Eastern Time on May 27, 2009 at ricardo.cordero@nist.gov, with a courtesy copy to joseph.widdup@nist.gov. Faxed quotes will not be accepted. EVALUATION FACTORS FOR AWARD The government will evaluate quotations and award a purchase order to the offeror whose technically acceptable quotation represents the lowest price to the Government. The purpose of amendment #1 is to extend the closing date from 05/27/2009 at 3:00 PM EST to 05/28/2009 at 3:00 PM EST
