- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION SUBJECT: Home Medical Equipment As required by FAR 6.303-2, the following information is provided for these procurements. 1. Requesting Agency: Central Texas Veterans Health Care System 1901 Veterans Memorial Drive Temple, TX 76504 Contracting activity: Central Texas Veterans Health Care System 1901 Veterans Memorial Drive Temple, TX 76504 2. Description of supplies or services required to meet agency needs, including estimated value: Provide labor, transportation, materials, tools and storage to provide Home Medical Equipment furnished to the VA to eligible beneficiaries of the Central Texas Veterans Health Care System. 3. An identification of the statutory authority permitting other than full and open competition. 41 U. S. C. 253 (c) (2), Unusual and compelling urgency 4. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Allumed is accredited by the Joint Commission, which is a contract requirement. This company has provided satisfactory delivery and repair services to veterans in the Central Texas area for over the past 10 years. 5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. This requirement, VA257-RP-08-RP-0187, was posted to FedBizOpps. FedBizOpps data showed that there were 41 vendors interested in this requirement; however, no offers were received. 6. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Price analysis will be will be utilized for this procurement. The proposal will be reviewed and the proposed price will be compared to the Independent Government Estimate (IGE). 7. A description of the market research conducted. Market research was conducted using a variety of methods. The Central Contractor Registration (CCR) allows research to be conducted using the Dynamic Small Business Search which is supported by the Small Business Administration. A search was also conducted from VetBiz and also the Joint Commission since this procurement requires a contractor to have Joint Commission accreditation in order to perform the services. Although there are a significant number of contractors providing service under this NAICS most lack the required Joint Commission Accreditation. 8. Any other facts supporting the use of other than full and open competition: It was anticipated at the time this requirement was identified that there would be competition among three (3) known vendors who were Joint Commission accredited. None of these vendors submitted a proposal which leaves the Central Texas Veterans Health Care System without a contract to provide home medical equipment to eligible beneficiaries. 9. A listing of the sources that expressed, in writing, an interest in the acquisition. None. 10. A statement of the actions the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. A sources sought document will be posted to FedBizOpps in an effort to identify potential offerors. The VA would request that potential offerors provide information with regards to their capabilities to provide the required service. When this requirement is reprocurred an Industry Day may be held in order to provide Industry the opportunity to ask questions which could result in a revision to a Statement of Work that may or may not have been completed. Industry input could result in a more cost effective way in which services may be provided. 11.
