Description
The Naval Air Systems Command, Naval Air Warfare Center Weapons Division(NAVAIR WD), China Lake, CA, intends to enter into negotiations for a Firm FixedPrice order GM01 under an existing Basic Order Agreement N00019-05-D-0019 or the follow-on BOA with Thalus Avionics SA of France. The requirement is for newdevelopment and updates to the Systems Operational Flight Program (OFP) andsystem interface for the Optimized Top Owl Helmet Mounted Sight Display (OTOHMSD). This development will include 2 OTO HMSD preliminary software builds and1 final software build. The Period of Performance for this order will be fromaward through March 2011. The UH-1Y and AH-1Z helicopters have been developed to incorporate the Thalesdesigned OTO Helmet system as part of the platform's state-of-the-art targetacquisition and engagement system. Therefore, OTO HMSD drawings, software anddesign data are necessary for the successful incorporation and integration ofthe system into the aircraft. This requirement will be procured in accordance with the statutory authoritypermitting other than full and open competition under 10 U.S.C. 2304(c)(1), asimplemented by the Federal Acquisition Regulation (FAR) 6.302-1(a)(2), in thatThales Avionics is the sole designer, developer, and manufacturer of the OTOHelmet. Thales Avionics is the only known company with the knowledge, data andcapability to provide the required development and updates for this system. Seenotes 22 and 26. All responsible sources believing that they can provide the required service maysubmit a capability statement, proposal, or quotation clearly showing theirability to perform the work without compromising the quality, accuracy,reliability and delivery of the product which shall be considered by the agency.All submissions must reference BOA number N00019-05-G-0019 order number GM01 andbe received at the contracting office no later than 11 June 2009. Award of this order is expected to be on or about 15September 2009. Note 22. The proposed contract action is for supplies or services for whichthe Government intends to solicit and negotiate with only one source under theauthority of FAR 6.302. Interested persons may identify their interest andcapability to respond to the requirement or submit proposals. This notice ofintent is not a request for competitive proposals. However, all proposalsreceived within forty-five days (thirty days if award is issued under anexisting basic ordering agreement) after date of publication of this synopsiswill be considered by the Government. A determination by the Government not tocompete with this proposed contract based upon responses to this notice issolely within the discretion of the Government. Information received willnormally be considered solely for the purpose of determining whether to conducta competitive procurement. Note 26. Based upon market research, the Government is not using the policiescontained in Part 12, Acquisition of Commercial Items, in its solicitation forthe described supplies or services. However, interested persons may identify tothe contracting officer their interest and capability to satisfy theGovernment's requirement with a commercial item within 15 days of this notice.
