- Justification for Other than Full and Open Competition The Naval Medical Logistics Command intends to negotiate on a sole source basis (IAW FAR 13.5) with Leica Microsystems, 2345 Waukegan Road, Bannockburn, IL 60015, as the only responsible source that is capable of providing a Peloris rapid tissue processor system. Specifically, the requirement is for one (1) rapid tissue processor system with one (1) high capacity basket kit. The system shall include the following components: 2 independent continuous processing chambers, Cassette capacity of 600 maximum, a throughput of 450 cassettes/hour, a reagent management system (concentration, cassettes, days, cycles), heating system (ActivFlo, non-microwave, rapid heat), reagent volume of 3.8 L minimum / 5 L maximum, 16 reagent stations, 4 paraffin wax stations (each station is capable of filling one retort). The system shall be able to use xylene-free processing techniques. The system shall be able to process tissue specimens of any type or size in less than 9 hours. The follow accessories shall be delivered with the rapid tissue processor system: 16 reagent bottles, condensate bottle, activated carbon filter, drip tray, 4 bottle label sheets, wax scraper, reagent drain hose, wax drain hose, remote alarm plug, o' ring lubricant, 10 touch screen protectors, bottle cap wrench, remote exhaust connection, USB memory stick, Peloris user manual CD, international mains power cable set, power cable retention kit, and a high capacity basket kit. The electrical requirements for this system are 100-120 VAC, 16 Amps and 60 Hz. Leica Microsystems is the only manufacturer of the Peloris rapid tissue processor system. This system is the only rapid tissue processor system that has independent dual-retort flexibility and continuous processing with the ability to have a 600 cassette capacity. This system is the only system capable to complete routinely overnight processes in an average of 7.5 hours (within a working day). This system is also able to shorten the process of small specimens at a rate of up to 450 cassettes/hour. The system and all of the components, shall be compliant with the Food and Drug Administration (FDA) requirements to market and deliver medical products for use in the United States of America, even should delivery be requested outside of the United States. The claims made for the product shall comply with the regulations of the FDA with respect to products for marketing and delivery of a medical product for use in the United States of America, even should delivery be requested outside of the United States. The system shall be installed in compliance with OSHA requirements. This acquisition is being conducted under simplified acquisition procedures (IAW FAR 13.5). There are no set-aside restrictions for this requirement. The intended procurement will be classified under North American Industry Classification System (NAICS) 339113 with a Small Business Size Standard of 500 employees. This notice of intent is not a request for competitive proposals and no solicitation document exists for this requirement. However, parties interested in responding to this notice will need to submit technical data sufficient to determine capability in providing the same product. All capability statements received within 15 days after publication of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Capability statements shall be submitted by email only as a MS Word or Adobe PDF attachment to James Suerdieck at james.suerdieck@med.navy.mil. Statements are due by 1200 Eastern, 12 JUN 2009.
