- Justification and Approvalfor Other than Full and Open Competition for Department of Veterans Affairs Office of Information & Technology (005) Cost Xpert Software Maintenance Renewal 1.Contracting Agency (FAR 6.303-2(a)(1)). The contracting agency for this purchase is: Department of Veterans Affairs OI&T - Albany OIFO 113 Holland Avenue (192-2A) Albany, NY 12208 Contracting Activity. The contracting activity for this purchase is: Department of Veterans Affairs Center for Acquisition Innovation - Austin 1615 Woodward Street Austin, Texas 78772 2.Nature and/or Description of Action Being Approved (FAR 6.303-2(a)(2)). This Limited Source Justification and Approval sets forth the facts and requests approval for the issuance of a Sole Source Requirement from Cost Xpert Group, Inc., 3131 Camino Del Rio North, San Diego, CA, 92108. The term of this contract will be for one (1) year at a cost of $3,600.00. 3.Description of Supplies or Services Required to Meet the Agency's Needs (including estimated value) (FAR 6.303-2(a)(3)). The purpose of this contract for the Department of Veterans Affairs, in cooperation with Cost Xpert Group, Inc., is to provide software management support and maintenance to include upgrades, updates, bug-fixes, and support. 4.Statutory Authority (FAR 6.303-2(a)(4)) - Identification of Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority for this justification is FAR 6.302-1 - 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. (a) Authority. (1) Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). (2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. 5.Rationale Supporting Use of Authority Cited Above (FAR6.303-2(a)(5)). (Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.) The Department of Veterans Affairs intends to award a sole-source contract to work in collaboration with the Office of Information & Technology (005). The contractor offers the following on a proprietary basis: "E-Mail accessibility "Software updates "Software upgrades "Software patches "Software maintenance support 6.Description of Efforts To Ensure That Offers Are Solicited From As Many Potential Sources As Practicable, Including Public Notice Requirements (FAR 6.303-2(a)(6)). (A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.) The Independent Government Cost Estimate (IGCE) is a firm fixed price of $3,600. After a search on NASA SEWP, GSA Advantage, and the Internet, no other providers were found from which to solicit quotes. 7.Determination of Fair and Reasonable cost (FAR 6.303-2(a)(7)). (A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.) The maintenance services needed by the VA are available from only one responsible source, Cost Xpert Group, Inc. Cost Xpert Group, Inc. has proprietary data rights to the Cost Xpert software, since they designed and developed the software. Using any vendor other than Cost Xpert would result in a significant loss of momentum in the development and enhancement of the software, a fragmentation in the continuity of key design elements, unnecessary and costly meetings, needless time delays, repetition and duplication of effort, and increased cost to the Government. 8.Market Survey (FAR 6.303-2(a)8)). (A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.) Market research was conducted on NASA SEWP, GSA Advantage, and the Internet. No other providers of Cost Xpert maintenance were found. 9.Other Facts Supporting the Use of Other Than Full and Open Competition (FAR 6.303-2(a)(9)). (9) Any other facts supporting the use of other than full and open competition, such as: (i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. (ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. (iii) When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.) None 10.List of Sources, If Any, That Expressed A Written Interest In The Acquisition (FAR 6.303-2(a)(10)). (A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.) Cision 11.Actions, If Any, That Are Being Taken to Remove and Overcome Any Barriers to Competition Before Any Subsequent Acquisitions for The Supplies or Services Required (FAR 6.303-2(a)(11)). (A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.) The Department of Veterans Affairs anticipates limited competition amongst vendors, if deemed appropriate. 12.
