Description
The Bureau of Indian Affairs (BIA) is soliciting offers to procure Hands-On Training Services from a qualified training company who maintain a current American Society of Mechanical Engineers (ASME) or National Board Inspection Code (NBIC) certification to provide a forty (40)-hour Boiler Operator Re-Certification Training for twenty (20) employees at Bureau of Indian Education (BIE), Eastern Navajo Agency (ENA), Branch of Facility Management, Building No. 3000, in Crownpoint, New Mexico. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation No. RMN00090073 herein cited is issued as a Request for Quote (RFQ) and will be procured under FAR Part 12, Acquisition of Commercial Items. Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-31. The objective of the training is to re-certify Boiler Operators to meet the qualifications for boiler preventive maintenance.The class shall consist of five (5) day classes, with instruction Monday through Friday, a minimum of 8 hours per day, from July 13, 2009 through July 17, 2009. CONTRACT CLAUSES: The following clauses apply to this acquisition: FAR 52.212-1, Instructions to Offerors Commercial Items; FAR 52.212-3, Offeror Representations and Certifications Commercial Items, FAR 52.212-4, Contract Terms and Conditions Commercial Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. In paragraph (a) of FAR 52.212-5 the following applies: FAR 52.233-3, Protest After Award (Aug 1996) (31 U.S.C. 3553); FAR 52.233-4, Applicable Law for Breach of Contract Claim (Oct 2004) (Pub. L.108-77, 108-78). In paragraph (b) of FAR 52.212-5(b), the Contractor shall comply with the following FAR clauses that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive order applicable to acquisitions of commercial items: FAR 52.225-1 Buy American Act-Supplies (June 2003) (41 U.S.C. 10a-10d); FAR 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration (Oct 2003)(31 U.S.C. 3332); and FAR 52.232-36, Payment by Third Party (May 1999) (31 U.S.C. 3332). FAR 52.232-18, Availability of Funds (April 1984), FAR 52.222-41, Service Contract Act of 1965 (Nov 2007) (41 U.S.C. 351, et seq.), FAR 52.222-42, Statement of Equivalent Rates for Federal Hires, (May 1989) and DIAR 1452.204-70, Release of Claims - Department of the Interior applies to this acquisition.
