- Department of Veterans AffairsVISN 10 Contracting Office 10000 Brecksville Road Brecksville, Ohio 44141-3204 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION May 15, 2009 IFCAP Transaction #: 541-09-3-2911-0712 Identification of Agency and Contracting Activity: The Louis Stokes Cleveland Department of Veterans Affairs Medical Center (VAMC), 10000 Brecksville Road, Brecksville, Ohio, 44141, VISN 10 Contracting Activity 90(C). Nature/Description of Action: Vendor shall provide all parts, labor, and supervision necessary to provide the Louis Stokes Cleveland VAMC's Research Department with a full service agreement for their General Advanced Image Microscope. Service shall include: -Scheduled and emergency service performed between the hours of 8:00am and 5:00pm Monday through Friday. -All travel charges will be included. -One (1) preventative maintenance inspection per service agreement year. -All covered replacement parts, except consumable items. -Software updates when available. -Factory trained Field Service Representatives Estimated Value: $11,200.00 Requesting Service: Research Identification of Statutory Authority: (X) 41 U.S.C. 253 (c) (1) Only One Responsible Source ( ) 41 U.S.C. 253 (c) (2) Unusual and Compelling Urgency ( ) 41 U.S.C. 253 (c) (3) Industrial, Mobilization, Engineering, Developmental, or Research Capability or Expert Services ( ) 41 U.S.C. 253 (c) (4) International Agreement ( ) 41 U.S.C. 253 (c) (5) Authorized or Required by Statute ( ) 41 U.S.C. 253 (c) (6) National Security ( ) 41 U.S.C. 253 (c) (7) Public Interest Rationale in support of citation in Paragraph 4 above: Upon the basis of the following justification, the use of other than full and open competition for the proposed task order is hereby approved pursuant to the authority of FAR 6.302-1: Soliciting from a single source precludes full and open competition and no other vendor can provide services that he Government requires. The activity proposes to solicit the services of Carl Zeiss MicroImaging, Inc., at the Louis Stokes Cleveland VA Medical Center, to provide a full service agreement for the General Advanced Image Microscope. This service agreement is critical to the mission of the Medical Center's Research Department to ensure that the multiple grants that utilize this piece of equipment is not delayed, exposing the Government to the risk of accruing additional costs. Determination of a Fair and Reasonable Cost: Pricing for these services are also the same that the "public" would pay. Pricing is also based on a previous purchase (541-D85018) of the service agreement for FY08. Additional Support for the use of other than full and open competition: Carl Zeiss is the only authorized source of factory trained service engineers to service and repair PASCAL systems.
