Description
The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 6.302-1 with Julabo USA of Allentown, PA for the purchase of Julabo LH-45 Temperature Control Bath to be used in the Center for Neutron Research at NIST, Gaithersburg, Maryland. *** NIST cites FAR 6.302-1(a)(ii)(A) and (B) (see excerpt below) as primary rationale for Sole Source Determination. (ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in -- (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or (B) Unacceptable delays in fulfilling the agency’s requirements. (See 10 U.S.C. 2304(d)(1)(B) or 41 U.S.C. 253 (d)(1)(B).) The Sole Source determination is based on the need for the Julabo LH-45 Temperature Control Bath with temperature control to operate in accordance with the original equipment specifications from the manufacturer. The NIST Center for Neutron Research does basic materials research that is useful for many basic and applied science disciplines including biology, chemistry, condensed matter physics, polymer research, etc. The purpose of this procurement is to increase the number of temperature baths used for sample temperature control on multiple neutron scattering instruments. These temperature baths are all the same so that they may be interchanged as necessary and so that their controls are familiar for the group of scientists employing them. The objective of this procurement is to purchase a Julabo LH-45 temperature control bath, along with providing options for the future purchase of this same item. The NIST Center for Neutron Research (NCNR) presently has three Julabo LH45 ultra-low refrigerated circulators that have a working temperature range from -40 to 250 C. These are all used on neutron scattering instruments for control of the sample environment. The NCNR is a user facility serving approximately 1000 unique guest researchers per year, putting a great emphasis on the reliability, uptime and standardization of our equipment. The Julabo has proven to be very reliable, capable, and fast. The reasons that we wish to purchase this Brand Name Only item are: 1) to maintain a consistent equipment interface for local and guest researchers; 2) to serve as a drop-in replacement spare; and 3) to prevent duplication of effort that would be required to integrate a new system. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor’s commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 423730, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 1:00 p.m. (EST) on June 19, 2009. Inquiries will only be accepted via email to janet.lamb@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
