- DEPARTMENT OF VETERANS AFFAIRSLOUIS STOKES CLEVELAND MEDICAL CENTER VISN 10 10000 Brecksville Road Brecksville, OH 44141-3204 JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to the authority of FAR 6.302-2. JUSTIFICATION 1.Identification of Agency and Contracting Activity. The Louis Stokes Cleveland Department of Veterans Affairs Medical Center, 10000 Brecksville Road, Brecksville, OH 44141-3204, Visn 10 Contracting Activity. 2.Nature/Description of Action. This activity proposes to procure an undefinitized purchase order with the American Red Cross Greater Cleveland Chapter (DBA Cleveland Red Cross CAGE: 1TJL6) for three months of blood bank services (e.g. blood supply and blood testing services) under decentralized authority to the using agency. This procurement provides a temporary solution to ensure continued critical blood bank services until a new contract can be awarded. The draft contract is currently under review. The period of performance is June 1 - June 30, 2009. 3.Description of Supplies/Services. This requirement is to allow the Cleveland VAMC's Pathology & Laboratory Management and Surgical services to maintain the level of patient care services required by the Medical Center's Quality Assurance Management. An adequate supply of blood and specialized blood testing services provided by a third party vendor is required to maintain surgical operations and allow clinical staff to treat emergency or urgent care veterans that present themselves the medical center. The estimated per month cost is not to exceed $139,000.00. This funding is for the period of performance of June 1, 2009 to June 30, 2009. 4.Identification of Statutory Authority. The statutory authority permitting URGENT AND COMPELLING procurement is FAR 6.302-2. 5.Rationale in support of citation in Paragraph 4 above: Description of contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: American Red Cross Blood Bank has been the sole provider of these services. This service is necessary to perform testing and data analysis as well as use in surgery in the Laboratory and Medical Services. The services are necessary to provide quality service for veterans at the VA Medical Center. The service is for direct patient care. Patients are being affected because they are the recipient of the blood either for transfusions, tests, and surgery. The departments must have blood on call for the various reasons mentioned above and can not store enough on station for this purpose. This presents an urgent and compelling need to continue these services with the only known vendor until the contract is completed. Failure to procure blood bank services for the hospital would threaten the health and well being of veterans-patients. 6. Federal Business Opportunities (Fedbizzops) Announcement/Potential Sources. This requirement will not be synopsized in accordance with FAR 5.202(a)(2). 7. Determination of a Fair and Reasonable Cost The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable based on price analysis of previous purchase 541-C90517 $139000.00. 8. Description of market survey. Initial market research has determined that the VA's has utilized only the incumbent vender in the past few years. 9. Additional Support for the use of other than full and open competition: None. 10. Sources expressing an interest: None. 11. Barriers to full and open competition: This is a temporary procurement to continue performance of a vendor during a new solicitation for the same service.
