- FBO ANNOUNCEMENT: COMBINED SYNOPSIS/SOLICITATION ACTION CODE: CLASSIFICATION CODE: 70 - GENERAL PURPOSE INFORMATION TECHNOLOGY EQUIPMENT SUBJECT: Coventor Turbo Floating Annual Software SOLICITATION NUMBER: NB162030-9-04781 RESPONSE DATE: June 9, 2009, 10:00 am (EST) CONTACT POINTS: Mary Alice Powe, Contracting Officer, (301) 975-8567 The Department of Commerce, National Institute of Standards and Technology (NIST) intends to negotiate a Firm Fixed Price Purchase Order on a Sole Source basis under other than full and open competition by the authority of FAR Subpart 13.106(b); with Coventor, Inc., Cary, North Carolina 27513 for the purchase of customized software provided annually by Coventor. Sole Source determination is based upon the sole proprietary and patent rights uniquely provided by Coventor. The software is to be used by the Center for Nanoscale Science and Technology, at the National Institute of Standards and Technology (NIST), Gaithersburg, Maryland campus. The software is needed for finite element numerical analysis of complex MEMS and NEMS devices in 3-dimensions. The period of performance for this product shall be ten (10) days after receipt of the purchase order. The North American Industrial Classification System (NAICS) code for this procurement is 541511. No solicitation package will be issued. The notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond ot his requirement. The Government will consider responses received by 10:00 AM (EST) on June 9, 2009. Inquiries will only be accepted via email to maryalice.powe@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition is based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
