- Justification for Other than Full and Open Competition (JOFOC) The U.S. Nuclear Regulatory Commission (NRC) proposes to enter into a sole source purchase order with Operation Technology, Inc., to purchase an additional user license for the existing Electrical Transient Analysis Program (ETAP) network WAN and to purchase maintenance and support services to cover the existing ETAP network WAN and the additional user. This software will be used by the NRC to perform confirmatory analysis of electrical distribution systems at nuclear power plants. In accordance with NRC regulations, 10 CFR 50, Appendix B, nuclear utilities are required to perform analyses of the electrical distribution systems installed in nuclear power plants in order to revise their license design basis. Performance of this analysis requires the use of computer simulation models. Approximately 88% of the U.S. nuclear power plants use the ETAP software for the analyses of their electrical distribution systems. In order for the NRC to make independent in-house assessments of the accuracy of the applicant’s analysis, the NRC staff must use identical software to the nuclear power plant (i.e. ETAP). Therefore, the NRC must use ETAP to perform confirmatory analysis of electrical distribution systems at nuclear power plants. Operation Technology, Inc. is the only organization that distributes and provides maintenance services for the ETAP software. The period of performance of this effort is July 1, 2009 through June 30, 2010. Requests for copies of this solicitation will not be honored unless the respondent provides evidence showing their capability to perform the required services. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1. Interested persons may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive proposals. A determination not to compete this requirement based on response to this notice is solely within the discretion of the Contracting Officer. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Any response must show clear and convincing evidence that competition would be advantageous to the Government.
