Description
Effective with this amendment, posted on 17 June 2009, the entire full text clause (i.e. 52.212-2, Evaluation Commercial Items Jan 1999) currently included in the solicitation is hereby revised by deleting paragraph 2, "Price: The Government may or may not award to the lowest-price proposal. For this requirement, all evaluation factors other than price, when combined, are significantly more important than price. The Government intends to award a contract to the responsible offeror whose proposal offers the best combination of technical capabilities and proposed price (i.e. the best value)". The following revised full text clause replaces the previous clause: FAR 52.212-2, Evaluation Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1. Technical - the capability of the services being offered to satisfy the requirements of the Performance Work Statement (PWS). The offeror shall provide with his/her offer sufficient documentation, specifically addressing subparagraphs 1.1 thru 1.5.4 of the PWS, para 1.0 (Description of Services). The accompanying documentation must be adequate to enable the Government to reasonably evaluate offeror's ability to successfully perform the requirements of the PWS. The Government shall evaluate offeror's total proposal for evidence of offeror's demonstrated understanding of both the specific tasks and substantive issues included in the PWS, including how offeror has demonstrated his/her ability to provide MEONet, EEONet, and Unit Climate Assessment with offeror's current capabilities with direct URLs to connect. 2. Lowest price technically acceptable (LPTA): An award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
