- THE US DEPARMTMENT OF LABOR (DOL) OFFICE OF PROCUREMENT SERVICES (OPS) HAS ENTERED INTO AN 18 MONTH LABOR HOUR CONTRACT (BASE YEAR PLUS 6 MONTH OPTION) FOR PROCUREMENT SPECIALIST SUPPORT SERVICES IN SUPPORT OF THE AMERICAN RECOVERY AND REINVESTMENT ACT (ARRA). THE CONTRACT HAS BEEN ISSUED AS AN SBA 8(A) SOLE-SOURCE UNDER THE PROCEDURES OF FAR 19.8. Determination and Findings for Use of Other than Firm Fixed Price Contracts: Upon the basis of the following findings and determination that I hereby make pursuant to the authority of FAR Subpart 16.6, the proposed contract described below may be entered into on a Time and Materials (T&M) basis. Description of the agency requirement: The United States Department of Labor (DOL), Office of the Assistant Secretary for Administration and Management (OASAM), Office of Procurement Services (OPS), requires the support of a contractor to provide Contract Specialist support services in support of the acquisition process under the American Recovery and Reinvestment Act (ARRA). Findings 1. The proposed procurement calls for the services of a contractor to support contract pre-award, administration, and post-award activities, being funded under the American Recovery and Reinvestment Act (ARRA).. 2. FAR Subpart 16.6 indicates that a Time and Materials contract is only appropriate when “it is not possible at the time of placing the contract to estimate the extent or duration of the work, or to anticipate costs with any reasonable degree of confidence.” At the time of award, neither the Program Office nor the Contracting Officer can determine the amount of support required with any reasonable degree of confidence. 3. A determination will be made prior to award, that the proposed contractor’s accounting system is adequate for the determination of costs applicable to the proposed contract, and the solicitation makes provisions for maintenance of adequate records and controls, including appropriate surveillance by Government personnel during the performance as to reasonably assure that inefficient or wasteful methods will not be used. Determination 1. In accordance with FAR 16.301-3(b), this is not a cost-reimbursement contract for the acquisition of commercial items. 2. It is impracticable to secure services of the kind or quality required, without the use of the proposed contract type. 3. The estimated cost of the proposed contract is $3,500,000.00, which includes labor and materials for the period of a twelve (12) month base period plus a six (6) month option period.
