- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, proposals are being requested and a written solicitation will not be issued. This is issues as a Request for Proposal. This solicitation document and incorporated provisions and clauses are those in effect thought Federal Acquisition Circular 05-33. The applicable North American Industry Classification Standard (NAICS) cost is 541519. The U.S. Army Aviation Applied Technology Directorate (AATD) intends to purchase Five (5) Seats of Siemens PLM Software FEMAP V 10.0.2 NX Nastran, product number E600, Basic (Node Locked) License. The intended source for the software is Saratech, Incorporated, 14 Monarch Bay Plaza # 429, Dana Point, CA 92629. Saratech Incorporate is the only known source/vendor having the brand name item/software and no other supplies or services will satisfy agency requirements. The Government requires updates to the FEMAP software and no other source can provide those proprietary updates. This requirement includes one year of technical support, i.e., telephone, email and pushes of software patches. AATD intends to award a purchase order on a firm-fixed-price basis under the contract number W911W6-09-P-0024 with Saratech Incorporated. Delivery of the software is intended for U.S. Army Aviation Applied Technology Directorate (AATD), Ft. Eustis, Virginia 23604-5577. Inspection/Acceptance is in accordance with FAR 52.212-4 and FOB Point is destination, AATD, Ft. Eustis, Virginia. The provision at 52.212-1, Instructions to Offerors Commercial Items, applies to this acquisition. Offeror shall describe the proposed technical support. Offeror shall include a completed copy of the provision at 52.212-3 Offeror Representations and Certifications Commercial Items, ALT I with their offer. The following FAR clauses are applicable to this acquisition. 52.212-4, Contract Terms and conditions Commercial Items, applies to this acquisition without addenda; 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. The following clauses cited within FAR 52.212-5 apply: FAR 52.222-3, Convict Labor; 52.222-19 Child Labor-Cooperation with Authorizes and Remedies, 52.222-21, Prohibition of Segregated Facilities, 52.222-26 Equal Opportunity, 52.222-36, Affirmative Action for Workers with Disabilities; 52.225-13 Restrictions on Certain Foreign Purchases, 52.232-33 Payment by Electronic Funds Transfer-Center Contractor Registration. The clause at DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items, applies to this acquisition. The following clauses cited within 252.212-7001 apply: 252.203-7000, Contracting Officers Representative (DEC 1991), 252.232-7003, Electronic Submission of Payment Requests; 252.247-7023, Transportation of Supplies by Sea, Alt IV, and 252.247-7024 Notification of Transportation of Supplies by Sea. As previously noted the intended source of supply is Saratech Inc. Specifications, plans or drawings relating to this procurement described are not available and cannot be furnished by the Government. Proposals are due on 25 June 2:00 p.m. Eastern Daylight Time. While Saratech Incorporated is the only known source because no other can provide updates of the properly FEMAP Software currently in use, and the Government does not anticipate competition, the following evaluation criteria apply: 1) capability to provide Siemens PLM Software FEMAP V 10.0.2 NX Nastran, product number E600, Basic (Node Locked) License, 2) compliance with delivery schedule and 3) price. When capability to provide the Siemens PLM software, the maintenance for 12 months and the completion of delivery schedule are combined, they are significantly more than price. However, interested persons may identify their interest and capability to respond to the requirement and submit a proposal. All responsible sources that submit an offer will be considered. Alpha contracting methods with Saratech will be utilized. A solicitation document is not available.
