- RECOVERY: THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY. The U.S. Department of Labor has awarded a time-and-materials type task order against existing IDIQ contract DOLJ099F28441 -- Development and Implementation of Log Data Collection and Analysis to Support Targeting of OSHA’s Interventions. Determination and Findings for Use of Other than Firm-Fixed Price Contracts: Upon the basis of the following findings and determination that I hereby make pursuant to the authority of FAR Subpart 16.6, the proposed task order described below may be entered into on a time and materials type basis. Description of the agency requirement: This task order is for a Contractor to support the expansion of the annual data collection to include the collection of work-related injury and illness data from approximately 20,000 establishments in the construction industry. The Contractor will serve as the data collecting agent for all construction industry establishments and will modify the existing software, as needed, to interface with other data sources; and assist OSHA in operating the system and executing activities that are essential for the successful completion of the data collection. The Contractor will also make the data available to the Agency for use on a real-time basis (i.e. the Agency will be able to access and use the data as it is collected). The contractor will assist the Agency in maintaining its recordkeeping program for employers in the construction industry and will provide ongoing support and outreach to assist OSA in meeting the programmatic needs. The activities during the contract will include the collection and finalization of the CY 2008 construction data, conduct the analysis of the data collected, and provide support for data quality improvement. Findings 1. The proposed procurement calls for annual data collection to collect work-related injury and illness data for the construction industry, as required by the Occupational Safety and Health Administration (OSHA) in support of Log Data Collection and Analysis to Support the Targeting of the Occupational Safety and Health Administration, to be funded under the American Recovery and Reinvestment Act (ARRA). 2. FAR Subpart 16.6 indicates that a time and materials type contract is appropriate only when “it is not possible at the time of placing the contract to estimate the extent or duration of the work, or to anticipate costs with any reasonable degree of confidence.” At the time of award, neither the Program Office nor the Contracting Officer was able to determine the amount of support required with any reasonable degree of confidence. 3. This task order is being placed against existing, competitively awarded, time and materials type IDIQ contract DOLJ099F28441. Determination 1. In accordance with FAR 16.301-3(b), this is not a cost-reimbursement contract for the acquisition of commercial items. 2. It is impracticable to secure services of the kind or quality required, without the use of the proposed contract type. 3. The estimated cost of the proposed task order is $600,000.00, which includes labor hours and other direct costs from May 29, 2009, through March 31, 2010.
