- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation VA-259-09-RQ-0299 is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-19. This is a competitive procurement under the North American Industrial Classification (NAIC) Codes 721110 and 621620. The Contractor shall provide Respiratory and Pulmonary services to Medical Service at the Eastern Colorado HealthCare System on site at the Denver VA Medical Center. The Contractor shall provide the full range of inpatient and outpatient Respiratory and Pulmonary Care services to these in accordance with the terms and conditions of this agreement. The Contractor shall provide treatment to eligible beneficiaries of the veteran's health care system who present themselves to the VA facility for treatment. Respiratory and Pulmonary Care personnel provided by the Contractor shall be of a quality meeting or exceeding currently recognized national standards as established by the Joint Commission on Accreditation of Healthcare Organizations (JC) and the American Hospital Association (AHA). The Contractor shall perform services in accordance with the ethical professional and technical standards of the health care industry. The standard or performance for any employee provided by the Contractor shall be to exercise that degree of care, skill and learning expected of a reasonably prudent health care provider in the profession or class to which he/she belongs. Performance shall be at or exceed the standards contained in this agreement. Specific tasks are delineated in Attachments herein. The Inpatient Respiratory Care Supervisor and Pulmonary and Critical Care Supervisor is held directly responsible for patient care provided by respiratory, pulmonary function lab and sleep lab staff within his/her auspice at the VA facility. All inpatient respiratory and pulmonary personnel are subject to directives, guidance and supervision from the Inpatient Respiratory Care Supervisor and Pulmonary and Critical Care Supervisor or designated representative. Contractor personnel performing services under this agreement are subject to the same directives as those provided to the VA respiratory and pulmonary service staff. PERSONNEL: Point of Contact/Substitute Coverage: The contractor shall provide the COTR with the names and telephone numbers of individuals who shall be the point of contact responsible for the day to day functioning of the details of this agreement. The point of contact shall have full authority to act for the Contractor on all matters relating to the daily operation of this agreement. The COTR, designated Program Support staff and/or the Off Tour Nursing Supervisor, will contact the Contractor's designated point of contact concerning personnel staffing problems or other issues requiring immediate attention. The Contractor's point of contact shall respond to phone calls from the COTR or other designated government representative within thirty (30) minutes on a twenty-four (24) hour a day, seven (7) day a week basis. The Contractor shall ensure that fully qualified back up personnel are available to provide coverage during scheduled and unscheduled absences of their primary personnel. The Contractor's representative shall meet with the COTR semi-annually during the agreement period. The meeting date and time will be scheduled by the COTR. Respiratory and Pulmonary Personnel: Personnel provided by this agreement shall be subject to the same quality assurance/quality management standards as those required for comparable VA or government personnel. Nursing and nursing support personnel shall be responsible for compliance with all policies and procedures in accordance with VA written policies, procedures and regulations, and VHA regulations. All personnel must maintain a neat personal appearance and professional decorum. All JC standards shall be met during the performance of this agreement. The government reserves the right to accept or not accept the Contractor provided personnel. In the event that any respiratory and pulmonary personnel are determined unacceptable by the Inpatient Respiratory Care and Pulmonary Supervisors at any time during the agreement period, the Inpatient Respiratory Care and Pulmonary Supervisors will determine whether the personnel shall be released from duty, and will notify the Contractor's point of contact, and the COTR that such individual shall not be resubmitted to provide service under this agreement. Non-acceptance of a contract employee does not relieve the Contractor from fulfilling the terms and conditions of this agreement. In the event of a dispute between the COTR and the contractor, the COTR's decision is final. Supervision: The Contractor's respiratory and pulmonary personnel are subject to supervision and direction by the Inpatient Respiratory Care and Pulmonary Supervisors and his/her representative. Work assignments will be made by the Inpatient Respiratory Care and Pulmonary Supervisors or his/her representative in each respective work area. Evaluation: In accordance with the requirement of JC, the outside agency will conduct an annual evaluation of each employee using a performance based method. Both the mechanism for evaluation and the verification of its use will be available and acceptable to the VA. The VA reserves the right to deny any contractor employee to be scheduled who has demonstrated problems with conduct, performance, punctuality or similar issues. Hours of Performance: The Contractor shall provide nursing and nursing support personnel to support a 7 day a week, 24 hours per day operation to include all holidays. The shift times shown below are the most common, but are not exhaustive. Eight and twelve hour work shifts include a 30 minute non paid lunch/dinner break except on the night shift where no meal break is provided. All shifts will provide 10 minute breaks every 4 hours. Shift 1 (Daytime hours) are 0730 - 1600, 0800 - 1630, 0600- 1830. Shift 2 (Night to morning) are 1800 - 0630, 1900 - 0600. Any 8 hour day shift may begin between the hours of 0600 to 1300. Weekends are defined as starting on Friday at midnight and ending on Sunday at midnight. (1) The government reserves the right to specify the beginning and ending time of work shifts. Duty hours can be changed at the discretion of the Inpatient Respiratory Care and Pulmonary Supervisors or his/her representative. Hours scheduled do not include travel time involved in reaching the place of duty. (2) Any employee provided by the Contractor shall not be scheduled to work more than 12 consecutive hours in a given 24 hour period in the performance of this agreement. (3) Sixteen hour shifts for coverage may be considered by the VA on a case-by-case basis. (4) The Government reserves the right to verify the hours worked by the Contractor to include implementing sign-in/sign-out procedures, and/or using a time clock if appropriate. Holiday Compensation: If the contractor employee is scheduled to provide services on a Federal holiday, payment at the rate of one and one half times the hourly rate, minus any authorized per diems, will be made. National Holidays: The ten holidays observed by the Federal Government are: New Years Day, Martin Luther King's Birthday, President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving, and Christmas, and any other day declared by the President of the United States to be a National Holiday. Time Schedule: Requirements will be projected as far in advance as possible; however for situations such as when patient workload increases, the VA reserves the right to request additional coverage. (1) In the event that the patient workload increases/decreases in any unit the Inpatient Respiratory Care and Pulmonary Supervisors or his/her representative reserves the right to re-assign the respiratory and pulmonary personnel to any appropriate care units or to cancel any scheduled shift or shifts. In the event that shifts must be cancelled. The COTR/the respiratory and pulmonary representative will contact the Contractor's point of contact at least 2 hours to the start of the shift to be cancelled. (2) A request for shift coverage is considered a late request if the request is made after the start of the shift. Any requests made prior to the start of the shift will not be considered a late request. Actual late requests may be billed for the entire shift. Infection Control: Health care providers provided by the Contractor shall exercise the universal precautions set forth by the Centers for Disease Control (CDC) when providing direct patient care at a VA facility. (1)Contractor staff shall not wear artificial nails, whether self or professionally applied, while providing direct patient care at the VA facilities. Uniforms: The contractor's employees shall be appropriately attired in accordance with VA uniform guidelines. The Contractor personnel shall also wear Contractor furnished badges identifying the employee and the employing company and a VA issued badge. The Contractor employee must wear this badge in accordance with regulation, and at all times while performing services under this agreement. (1) All personnel will wear special protective clothing and/or equipment provided by the VA when directed, or as necessary for infection control purposes. (2) The wearing of jewelry will comply with standards in accordance with VA policy. Key Control: When respiratory and pulmonary support personnel utilize any keys that belong to the VA, the keys must be returned to the Respiratory and pulmonary staff prior to leaving at the end of the shift. When keys are inadvertently taken from the VA by Contractor personnel, the Contractor is responsible for ensuring that the keys are returned within eight (8) hours of removal. No key may be duplicated. Document Security: All evaluations, records, reports, document and other records of patients, whether in paper, verbal, or electronic form will remain the property of and subject to the exclusive control of the respective VA facilities and the US government. All reports and documents prepared by the Contractor's employees in the fulfillment of this agreement are the property of the VA and the US government. Contractor staff must complete all required information security training, must comply with security requirements including the return of or destruction of all working documents with patient information prior to leaving the assigned work area. CONFLICT OF INTEREST: A. Contractor personnel shall not, while performing services under this agreement, advise, recommend or suggest to persons eligible to receive medical care at the VA that such persons should receive care from the Contractor, or any facility the employee is associated with. B. Contractor personnel are not prohibited by reason of their employment under this agreement from conducting private practice, if there is no conflict with the performance of services under this agreement. C. Contractor personnel shall not use VA facilities or other Government property in connection with conducting a private practice. D. In exercising this agreement the Contractor shall not use as a consultant of employee (either on a full or part time basis) any full time government employee. E. Confidentiality of Information: Unless otherwise specified, all financial, statistical, personnel and/or technical data which is furnished, produced or otherwise available to the Contractor during the exercise of this agreement are considered confidential and proprietary information, and shall not be used for purposes other than performance of work under this agreement. None of the above information shall be released by the Contractor without prior written consent of the COTR. ORIENTATION: A. The contractor shall ensure that all contract personnel participate in VA defined orientation procedures applicable for newly assigned contract personnel to include regulations specific to the profession or class to which he/she belongs, local VA policy and procedures, and VHA policy and procedures. Orientation may consist of self paced written/on-line education, classroom hours and/or unit orientation and hands-on skill validation. B. The Contractor shall strive to schedule contract personnel work at least a minimum of one shift in the 3 months following orientation. This requirement does not constitute a guarantee of shifts. In the event that the Contractor employee does not work in a minimum of one shift in the 3 months following his/her orientation, that employee may have to repeat the orientation, at the cost of the contractor. QUALIFICATIONS: The Contractor personnel shall meet the following minimum qualifications: A. Shall be capable of performing the full range of applicable respiratory and pulmonary support services within the areas assigned at the VA facility. B. Shall provide to the COTR, prior to performance of work, a written statement attesting to the fact that the Contractor personnel have received training as required by the Occupational. Safety and Health Administration (OSHA) Standard, dated December 1991, subject: Occupational Exposure to Blood borne Pathogens (29 CFR Part 1910, 10230) and the date training was completed written verification of completion of VA facility required mandatory training, including but not limited to Infection Control, Blood Borne Pathogens, Hazard Communication, Fire Safety, Emergency Preparedness, Information Security, Code of Organizational Ethics, Security Management, and VHA Privacy Policy Training (HIPPA). Contractor personnel may be required to review specific polices and procedures and sign statement that they have read these directives, understood the contents and will comply with the requirements or may face administrative action. Examples may include but are not limited to policies regarding Bar Code Medication Administration, Parking regulations and Cell Phone Usage. C. Shall provide to the COTR or designee for each Contractor personnel prior to the performance of work: (1) Copy of valid and unencumbered licenses and certifications for licensed or certified employees. (2) Social Security Number (3) Completion of VA Personal Identification Verification and VET Pro D. The Contractor is responsible for maintaining records that ensure all required licenses and documentation are current, complete and available prior to the first day of work at a VA facility. Upon request, the Contractor will provide to the COTR or designee copies of any and all required documentation of: (1) Current and valid licenses and certifications. (2) Current certification of BLS/CPR. ACLS certification is preferred and may be required in some specialties. (3) Evidence of current required immunizations, inoculations, etc. (4) Current Curriculum Vitae (or equivalent) describing educational and professional qualifications. E. Contractor personnel must be eligible for US employment and be able to provide proof of employment eligibility. Contractor personnel who are not US citizens must possess proper immigration documentation (Green Card, Visa, etc) and be licensed within the US. F. Certified/Registered Respiratory Therapist Intensive Care. See Attachment A. G. Certified/Registered Respiratory Therapist Outpatient Care. See Attachment B. H. Polysomnographic Sleep Therapist. See Attachment C. SECURITY REQUIREMENTS: A. Contractor personnel security requirements: All contractor employees who require access to the Department of Veterans Affairs computer systems shall be the subject of a background investigation, and must receive a favorable adjudication from the VA Office of Security and Law Enforcement prior to contract performance. This requirement is applicable to all subcontractor personnel requiring the same access. If the investigation is not completed prior to the start date of the contract, the contractor will be responsible for the actions of those individuals they provide to perform the work. (1) Position Sensitivity - the position sensitivity has been designated as Low Risk. (2) Background Investigation - The level of background investigation commensurate with the required level of access is National Agency Check with Written Inquiries. (3) Cost of each Background investigation is estimated at $200.00 B. Contractor Responsibilities: (1) The contractor shall bear the expense of obtaining background investigations. If the investigation is conducted by the Office of Personnel Management (OPM), the contractor shall reimburse the VA within 30 days of receipt of a bill of collection. Background investigations are permitted if the agency possesses and OPM and Defense Security Service certification. A Cage Code number must be provided to the Office of Security and Law Enforcement, which will verify the information and advise the Contracting Officer whether access to the computer systems can be authorized. (2) The Contractor shall prescreen all personnel requiring access to the computer system to ensure they are eligible for employment, and are able to read, write, speak and understand the English language. (3) After award and prior to contract performance, contractor will submit to the COTR or designee: List of names of contractor personnel. Social Security Number of contractor personnel. Contractor's mailing address to send security package. (4) Contractor shall notify the COTR prior to changing/adding new contract personnel by submitting the above information. (5) The contractor shall submit or have their employees submit the following required forms to the VA Office of Security and Law Enforcement within 30 days of receipt: a. Standard Form 85P, Questionnaire for Public Trust Positions b. Standard Form 85P-S, Supplemental Questionnaire for Selected Positions c. FD 258, U.S. Department of Justice Fingerprint Applicant Chart d. VA Form 0710, Authority for Release of Information Form e. Optional Form 306, Declaration for Federal Employment f. Optional Form 612, Optional Application for Federal Employment (6) The contractor, when notified of an unfavorable determination by the Government, shall withdraw the employee from consideration from working under the agreement. (7) Failure to comply with the contractor personnel security requirements may result in termination of the agreement for cause. Government Responsibilities: (1) The VA Office of Security and Law Enforcement will provide the necessary forms to the contractor or to the contractor's employees after receiving a list of names and addresses. (2) Upon receipt, the VA Office of Security and Law Enforcement will review the completed forms for accuracy and forward the forms to OPM to conduct the background investigation. (3) The VA Office of Security and Law Enforcement will notify the contracting officer and contractor after adjudicating the results of the background investigations received from OPM. The Contracting Officer will ensure that the contractor provides evidence that investigations have been completed or are in the process of being requested. HEALTH REQUIREMENTS: A. The Contractor shall provide the COTR with a certificate that the Contractor personnel have had a medical evaluation prior to the start of work under this agreement. This certificate shall state the date on which the examination was completed, the provider's name that performed the examination, and a statement concerning the health of the individual in accordance with the requirements set forth in the VA Occupational Health policy. The certificate shall also contain the following statement: "(name of the contract personnel) is suffering from no contagious diseases." B. The Occupational Health and Safety Administration (OSHA) requires that all personnel who will have occupational exposure to blood or body fluids or other potentially infectious materials shall receive Hepatitis B vaccine, sign a voluntary declination or have documented proof of immunity to Hepatitis B infection. The Contractor will provide certification of immunization, documentation of immunity or a signed voluntary declination to the COTR prior to performing work under this SOW. C. It is the Contractor's responsibility to report to the COTR all information necessary to assure VA records can be correctly maintained, and therefore, comply with JC, OSHA and Centers for Disease Control (CDC) health records requirements. D. The Contractor shall, upon request, provide the COTR with documentation of: Hepatitis B Vaccine (or waiver), Negative TB Skin test or Negative Chest X-ray. CREDENTIAL REVIEWS: A. General. The requirements of the Government, as stated in this SOW, are for the performance of respiratory and pulmonary support services. As a prerequisite to performance under the resultant agreement, the Respiratory providers performing the services shall have prime source verification of licensure completed through the VA HR office. (1) Prime source verifications are subject to the provisions of the VA Quality Improvement Policy and applicable regulations and any subsequent changes to that policy or regulation or any successor policies and regulations that might evolve. VA QUALITY ASSESSMENT AND IMPROVEMENT (QA &I): The VA will monitor the Contractor's performance under this agreement using the QA&I procedures established by VA and pursuant to the Inspection of Services Clause. Additionally, the Contractor's performance is subject to scheduled and unscheduled review by the QA & I as defined by the VA QA & I Plan and any other applicable regulation or statute. RESTRICTIONS AND CONSTRAINTS: A. The Contractor shall not bill a patient, an insurer or anyone else for services rendered. The only compensation the Contractor is entitled to for performing services is specified by this agreement. B. The Contractor shall perform procedures compatible with the VA's operating capacity and equipment. The Contractor shall not introduce new procedures or services without prior recommendations to and approval of the Inpatient Respiratory Care and Pulmonary Supervisors and the COTR. C. Contractor personnel shall be able to speak, understand, read and write English fluently. D. Contractor personnel shall be computer literate to the extent that they will be required to learn and use the computerized medical record (CPRS, BCMA and EVENT CAPTURE). E. Contractor personnel shall be rested and fully physically and mentally capable of performing the duties required under this agreement. F. Contractor personnel shall conduct themselves in an appropriate and professional manner. All facility personnel and/or patient complaints will be reviewed by the Inpatient Respiratory Care and Pulmonary Supervisors or his/her representative. Complaints will be presented by the COTR to the Contractor for resolution. Failure to resolve the complaints may necessitate appropriate action by the VA. In the event of litigation/investigation of a claim of liability or malpractice, the Contractor shall cooperate fully with VA and Government authorities and designated officials in the investigation of the claim or preparation of litigation. In addition, the Contractor shall: (1) Immediately notify the Inpatient Respiratory Care and Pulmonary Supervisors, through the COTR and promptly furnish copies of all pertinent papers received. (2) Cooperate with the VA, without further compensation, in the processing, review, settlement or defense of the suit, action or claim. H. If the Contractor providing services under this agreement has pending litigation or administrative proceedings that may affect a Contractor employee's license to practice nursing or his/her standing as a fellow/member in a professional organization, full disclosure shall be provided to the Inpatient Respiratory Care and Pulmonary Supervisors or his/her designated representative within five (5) calendar days upon his/her notification by the judicial or administrative forum. I. If it is determined by the medical legal review that the standard of care has not been met or there is substantial evidence of negligence on the part of the Contractor, regardless of the final judicial decision, the agreement may be immediately terminated at the discretion of the VA. J. It is the responsibility of the Contractor and/or employee to provide professional liability coverage. K. The Contractor shall, without additional expense to the VA or Government, be responsible for obtaining any necessary licenses and permits to comply with any applicable Federal or State laws, codes and regulations in connection with the performance of the type of services required by this agreement. L. The Contractor personnel shall, without additional expense to the VA or Government, continue to meet the minimum standards for continuing education (CE). M. Smoking is not permitted within the VA facilities. Smoking is permitted only in designated areas. N. The Contractor must comply with VA regulations and policies to include, but not limited to: vehicle registration policies and procedures, fire, safety, sanitation, security, traffic, parking and possession of firearms or other lethal weapons. DEFINITIONS: A. Ancillary Personnel: Personnel commonly referred to as a Pulmonary Function Technician, and Polysomnographic Sleep Therapist. Also clerical, secretarial and receptionist personnel are commonly considered administrative support personnel. B. Beneficiaries of Veterans health services: Those individuals entitled to care at the VA. C. Clinical Privileges: Authorization by the VA Director to provide specific patient care and treatment services in the organization, within well-defined limits, based on the individual's license, education, training, experience, competence, judgment and physical and mental health. Clinical Privileges are granted through the Chief of Staff credentialing and privileging processes. D. Continuing Education: Education beyond initial professional preparation that is relevant to the type of patient care delivered in the organization that provides current knowledge relevant to the individual's field of practice and that is related to findings from QA & I activities. E. Contracting Officer: A person with the authority to enter into, administer and/or terminate contracts and make findings and determinations on behalf of the Government. F. Military Time is on a 24-hour clock, i.e. 8: 00 a.m. = 0800, 9: 10 a.m. = 0910, NOON = 1200, 12: 18 p.m. = 1218, 8: 00 p.m. = 2000, MIDNIGHT = 2400, 12: 01 a.m. = 0001. G. Contractor: The word contractor as used throughout this SOW refers to the provider(s) and personnel performing work under this agreement. H. Privileging Process: Process established by VA for granting clinical privileges to health care providers. I. Quality Assessment and Improvement: An ongoing program designated to objectively and systematically monitor and evaluate the quality and appropriateness of patient care, to pursue opportunities to improve patient care and to resolve identified problems. J. Statement of Work: A document that accurately describes the essential and technical requirements for items, materials or services; including the standards used to determine whether the contract requirements have been met. K. Abbreviations: AHA - American Hospital Association, AMA - American Medical Association, AOD - Administrative Officer of the Day, BCLS - Basic Cardiac Life Support, COR - Cardiac or Respiratory Arrest, CRT - Certified Respiratory Therapist, COTR -Contracting Officer's Technical Representative, CPR - Cardiopulmonary Resuscitation, DEA - Drug Enforcement Administration, EMS - Emergency Medicine Service, ER - Emergency Room, FL -Form Letter, FTE -Full Time Equivalent, JC-Joint Commission on Accreditation of Healthcare Organizations, MAT -Medical Assist Team, Pam -Pamphlet, QA & I - Quality Assessment and Improvement, RPSGT - Registered Polysomnographic Therapist, RRT - Registered Respiratory Therapist, RRT's - Rapid Response Team, SF- Standard Form, SOW - Statement of Work, VA -Veterans Affairs, meaning the VA facilities involved in this contract. GOVERNMENT FURNISHED PROPERTY AND SERVICES: Government furnished property under this agreement will be furnished to the Contractor at no cost and shall be used in performance of services under this agreement. A. Facilities: During the hours of performance under this agreement the Contractor shall have the use of space currently available in the VA facility for performing all services associated with this agreement. No alterations to the work space shall be made by the Contractor. Contractor's items of clothing, personal effects or equipment cannot be secured on the work site during his/her absence. B. Supplies: The VA will furnish all supplies necessary for medical care except as stated in paragraph XVII.A. C. Regulations/ Directives/ Forms: Unless noted otherwise, all required Regulations, Directives and Forms as listed in section XX will be made available by the COTR for use/review when requested by the Contractor. D. Equipment: VA equipment currently on hand will be made available to the Contractor for use in performing services under this agreement. E. Emergency Health Care: VA will provide emergency health care for the Contractor for injuries occurring while on duty at the VA facility. These services will be billed to the Contractor at the current full charge rate. F. Physical Security/ Key Control: the Contractor personnel may be issued keys. The Contractor must safeguard the keys from loss, theft or destruction, and must display all keys signed for at scheduled or unscheduled key control inspections. The Contractor shall be required to reimburse the VA for lost keys or locksets, if locksets are required to be replaced as a result of lost keys. Charges will not exceed those applied to VA personnel. G. The Contractor will be allowed to use the VA dining facility while on duty. H. The VA will provide required forms used in the performance of services. I. All records, files, documents, forms and work papers provided by the VA remain VA property. CONTRACTOR FURNISHED ITEMS AND SERVICES: The Contractor shall provide his/her own stethoscope. SPECIFIC TASKS: The Contractor shall: A. Perform the range of respiratory and pulmonary support services as required by this agreement. The quality of the services provided shall meet or exceed the standards of professional practice for the health care provided as determined by the same authority that governs VA professionals in the same discipline or class and as specified below. (1) Provide medical care for/to all authorized beneficiaries. The VA will determine patient eligibility for care. The Contractor shall refer all questions concerning patient eligibility for care to the Eligibility Center. (2) Use all available VA resources for the optimal care of patients under this agreement. B. Perform the following functions within the scope of accepted nursing practice. This list of duties is not intended to establish either a maximum or minimum acceptable level of effort or be an inclusive listing of anticipated duties. Productivity is expected to be compared to that of other personnel assigned to the VA who are authorized the same scope of practice. Workload includes either scheduled or emergency requirements for care according to VA standards. Routine workload is scheduled by the VA. (1). Certified/Registered Respiratory Therapist Intensive Care. See Attachment A. (2). Certified/Registered Respiratory Therapist Outpatient Care. See Attachment B. (3). Polysomnographic Sleep Therapist. See Attachment C. C. Remain in the work area or be immediately available to the work area throughout each tour of duty. The Contractor shall not leave a tour of duty early without a suitable replacement and approval of the Inpatient Respiratory Care and Pulmonary Supervisors or his/her designated representative. For an on-going episode of care, he/she shall continue working at the end of the shift until the arrival of an appropriate replacement to assume responsibility for patient care. D. Advise the COTR of any problems encountered, or which may be encountered, in connection with meeting the needs of patients treated, including problems with regard to VA personnel. E. Attend the type and estimated quantity of patient care and administrative meetings as designated by the Inpatient Respiratory Care and Pulmonary Supervisors or his/her representative. F. Respond in writing to the COTR regarding facility and/or patient complaints pertaining to services or conduct. Such formal complaints will be referred to the Contractor by the COTR. G. Ensure that all JC standards for professional nursing care shall be met during exercise of this agreement. H. Complete competency data files on all contract personnel as required by the VA. The Contractor will provide copies of these documents upon request. APPLICABLE PUBLICATIONS AND FORMS: Government publications applicable to this SOW are listed below. Supplements, amendments or changes to these publications may be issued during the life of the agreement. Any such changes to publications which cause a change in performance within the meaning of the "Changes" clause will not be implemented by the Contractor unless or until a change order or modification to the agreement is issued by the contracting officer. A. Publications: Public Law 91-596; 29 Dec 70; Occupational Safety and Health Administration, JC; Joint Commission for Accreditation of Healthcare Current Edition Organizations (JCAHO) Manual. B. Forms: Standard Form 85P; Questionnaire for Public Trust Positions, Standard Form 85P-S; Supplemental Questionnaire for Selected Positions, FD 258; U.S. Department of Justice Fingerprint Applicant Chart, VA Form 0710; Authority for Release of Information Form, Optional Form 306; Declaration for Federal Employment, Optional Form 612; Optional Application for Federal Employment.FEE SCHEDULE: Contractor shall provide the following services. The contractor shall list an hourly fee for respiratory and pulmonary services for each shift, prices are to be all-inclusive. No additional charges will be paid for transportation, per diem, etc. Note: The VA will not request any shift less than four continuous hours. If the VA cancels a request that been scheduled confirmed in writing by the Contractor less than two hours prior to the beginning of the scheduled shift, the VA will pay an amount equal to four hours at the fee rate of the personnel scheduled. A. Certified Respiratory Therapist - Intensive Care, Weekday/Weekend, Holiday/Overtime. B. Registered Respiratory Therapist - Intensive Care, Weekday/Weekend, Holiday/Overtime. C. Certified Respiratory Therapist Technician - Outpatient, Weekday/Weekend, Holiday/Overtime. D. Registered Respiratory Therapist - Outpatient, Weekday/Weekend, Holiday/Overtime. E.Registered Polysomnograhic Sleep Technician, Weekday/Weekend, Holiday/Overtime. INVOICES: Payment will be monthly in arrears via electronic funds transfer upon submission of a properly prepared invoice. Invoices are to be fully itemized, listing dates and hours worked, employee's names, and unit of total dollar amounts. The contract number and purchase order number shall also appear on all invoices and correspondence. Invoices are to be submitted to the following payment office: VA FSC, PO Box 149971, Austin, TX 78714. TERMS AND CONDITIONS: A. Nothing in this Agreement shall be construed to obligate the ECHCS to purchase any or all services listed, nor shall the VA be prevented from buying services from another source. This agreement does not eliminate any legal obligations that have been placed upon the Government to buy from mandatory sources or to meet small business goals. LIABILITY: Prior to award, contractors are required to comply with applicable Federal and State workers compensation and occupational disease statutes. If occupational diseases are not compensated under those statutes, they shall be covered under the employer's liability section of the insurance policy. Employer's liability coverage of at least $1,000,000.00 is required. Attachment A: Requirements for Certified or Registered Respiratory Therapist - Intensive Care. 1. Qualifications: Each CRT/RRT shall: A. Hold a Diploma, Associates Degree (AD) or Bachelor of Science in Respiratory Therapist degree from an AMA accredited program, college or university and hold a current license to practice as a Certified or Registered Respiratory Therapist in the state of Colorado. B. Have been actively practicing as a certified/registered respiratory therapist in an intensive care setting for the past year. C. Be capable of providing complex and comprehensive respiratory care for adult medical and surgical patients. D. Have and maintain current Basic Cardiac Life Support (BCLS) and/or Advanced Cardiac Life Support (ACLS) certifications. E. Have no health or physical disability restrictions that interfere with the performance of assigned duties. H. Have documented training and skills verification. 2. Duties and Responsibilities. The CRT/RRT shall: A. Provide complex and comprehensive intensive care respiratory services within the professional scope of practice for a variety of diagnoses for patients of all ages. B. Conduct initial assessment on patients; develop respiratory care plans based on identified patient needs, attend patient rounds with the Pulmonary Staff, coordinate with ancillary services to assure provision of care, document all assessments and care provided. Provide patient and family education throughout the hospitalization. Initiate discharge planning. C. Administer oxygen, ventilator management, weaning parameters, deliver respiratory medications, ABG's, CPAP set-ups, COR's, RRT's, and MAT's in accordance with VA policy. D. Observe and assess patients' clinical condition, recognize and promptly report significant changes indicative of complications. E. Initiate resuscitative measures in emergency situations. F. Operate and monitor specialized equipment including, but not limited to: oxygen, Vision Bi-PAP's, Home CPAP and Bi-PAP units, Draeger ventilators, portable ventilators, pulse oximeters used for titration and nocturnal studies, ETCO2 monitors, bedside spirometries, bedside bronchoscopies, various types of suction apparatus, cardio-respiratory monitors vital sign monitors. G. Provide post-procedure and post-operative recovery care. H. Ensure that all JCAHO standards for professional respiratory care are met during performance of care. I. Complete appropriate medical record forms in compliance with VA guidelines and policies on each patient. J. Verify the content and correctness of all recorded entries in the patient record. All Documentation/records/reports must meet or exceed established VA standards to include, but not limited to: timeliness, legibility, accuracy, content and signature. The outpatient record shall be completed the same day the patient is seen. K. Respond to emergency codes as directed and summon appropriate backup from the clinical and hospital staff. Attachment B: Requirements for Certified or Registered Respiratory Therapist - Outpatient. 1 Qualifications: Each CRT/RRT shall: A. Hold a Diploma, Associates Degree (AD) or Bachelor of Science in Respiratory Therapist degree from an AMA accredited program, college or university and hold a current license to practice as a Certified or Registered Respiratory Therapist in the state of Colorado. B. Have been actively practicing as a Certified or Registered Respiratory Therapist for the past one year. C. Be capable of providing pulmonary function tests, polysomnographic testing, and home care. D. Have and maintain current Basic Cardiac Life Support (BCLS) certification. E. Have no health or physical disability restrictions that interfere with the performance of assigned duties. F. Have documented training and skills verification. 2. Duties and Responsibilities: The CRT/RRT shall: A. Provide comprehensive pulmonary function tests, polysomnographic testing, and home care services within the professional scope of practice for a variety of medical/surgical diagnoses. B. Conduct Pulmonary Function Testing to include Pre/Post Spirometry, DLCO, Body Plethysmography, Slow volume loops, Pre-op Spirometry, ABG's, exercise oximetry, methacholine challenge, formal exercise testing, bedside Spirometry, Chest clinic testing. OR Conduct Polysomnographic Testing to include patient testing oximetry, EEG, EKG, and EMG. Setting up CPAP or Bi-PAP or oxygen as needed. Stage and Score a polysomnographic test per AASM guidelines. C. Observe and assess patients' clinical condition, recognize and promptly report significant changes indicative of complications. D. Initiate resuscitative measures in emergency situations. E. Operate and monitor specialized equipment including, but not limited to: pulse oximeters, plethysmography box, portable Spirometer, formal exercise machine, treadmill, EKG monitor, blood pressure monitor, or CPAP or Bi-PAP machines, Formal Sleep Study equipment, capnographs. F. Ensure that all JCAHO standards for professional respiratory care are met during performance of care. G. Complete appropriate medical record forms in compliance with VA guidelines and policies on each patient. H. Verify the content and correctness of all recorded entries in the patient record. All documentation/records/reports must meet or exceed established VA standards to include, but not limited to: timeliness, legibility, accuracy, content and signature. The outpatient record shall be completed the same day the patient is seen. Attachment C: Requirements for Registered Polysomnographic Sleep Technician. 1. Qualifications: Each RPSGT shall: A. Hold a Diploma. Licensure is not required for this job classification. B. Have been actively practicing as a Registered Polysomnographic Sleep Technician for the past 12 months. C. Be capable of providing polysomnographic testing. D. Have and maintain current Basic Cardiac Life Support (BCLS) certification. E. Have no health or physical disability restrictions that interfere with the performance of assigned duties. F. Have documented training and skills verification. 2. Duties and Responsibilities: The RPSGT shall: A. Provide comprehensive polysomnographic testing services within the professional scope of practice for a variety of medical/surgical diagnoses. B. Conduct Polysomnographic Testing to include patient testing oximetry, EEG, EKG, and EMG. Setting up CPAP or Bi-PAP or oxygen as needed. Mask fittings, multiple sleep latency testing. Stage and Score a polysomnographic test per AASM guidelines. C. Observe and assess patients' clinical condition, recognize and promptly report significant changes indicative of complications. D. Initiate resuscitative measures in emergency situations. E. Operate and monitor specialized equipment including, but not limited to: oxygen, Formal sleep study equipment, pulse oximeters, CPAP and Bi-PAP machines. F. Ensure that all JCAHO standards for professional respiratory care are met during performance of care. G. Complete appropriate medical record forms in compliance with VA guidelines and policies on each patient. H. Verify the content and correctness of all recorded entries in the patient record. All documentation/records/reports must meet or exceed established VA standards to include, but not limited to: timeliness, legibility, accuracy, content and signature. The outpatient record shall be completed the same day the patient is seen. Proposals received in response to this solicitation will be evaluated per FAR 52.212-2 against the following criteria: 1. Information concerning the availability of services and the ability of the contractor to make delivery within 24 hours in emergency situation. 2 Information concerning contractor validation of staff competencies. 3. Price. Technical and past performance, when combined, are approximately equal to cost or price. At least three (3) references to which the contractor provides similar services under a similar agreement, including name of customer, name of contact person and telephone number. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The provisions at FAR 52.212-1, Instructions to Offerors-Commercial items applies to this acquisition with the following changes, items (e) and (h) of the standard clause are deleted. Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial items, with their offer. The clause at FAR 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition which shall include the following clauses: 52.203-13, 52.219-4, 52.219-8, 52.219-23-Alternate I, 52.219.25, 52.219-28, 52.222-3, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-39, 52.222-54, 52.225-5, 52.225-13, 52.222-41, 52.222-42, and 52.222-43. The Contractor shall comply with these FAR and VAAR clauses applicable to commercial services that will be incorporated in the contract award by reference to implement provisions of law or Executive orders applicable to acquisitions of commercial items: FAR 52.212-1, 52.215-8, 52.215-19, 52.216-1, 52.217-8, 52.217-9 (which provides that the Government may extend the term of the contract within 60 calendar days, provided that the Government shall provide a preliminary notice of intent at least 60 calendar prior to the expiration date; and services under this contract shall not exceed five (5) years), 52.219-22, 52.232-18, 52.232-19 (which provides that funds are not authorized past September 30 of any fiscal year, unless written authorization is received from the Contracting Officer), 52.233-2, and VAAR 852.233-70, 852.233-71, 852.270-1.
