- THIS FILE CONTAINS THE SCOPE OF WORK AND A SITE MAP. THIS FILE CONTAINS THE BID SCHEDULE AND REPRESENTATIONS AND CERTIFICATIONS. OFFERORS MUST FULLY COMPLETE THESE DOCUMENTS TO BE CONSIDERED RESPONSIVE TO THE SOLICITATION. This is a combined synopsis/solicitation for commercial items in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; price proposals are being requested and a written solicitation will not be issued. The solicitation number is W912P6-09-R-0015 and is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 01-23. RECOVERY ACT FUNDS ARE BEING USED TO FUND THIS ACQUISITION. The NAICS code for this requirement is 327331, with a small business size standard of 500 employees. This acquisition is UNRESTRICTED to Business Size. The provisions at 52.212.1, Instructions to Offerors-Commercial applies to this acquisition. Offerors must include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items with this offer. The clause 52.212-4, Contract terms and conditions-Commercial Items applies to this acquisition. The clause 52.212-5, Contract Terms and Conditions required to implement Statues or Executive Orders-Commercial Items applies to this acquisition. The following clauses listed in 52.212-5(b) and (c) are included by reference: 5.222-21; 52.222-22; 52.222-23; 52.222-41; 52.225.3; and 52.232-34; 52.232-16. The following Recovery Clause also apply to this acquisition: Clauses 52.204-11, "AMERICAN RECOVERY AND REINVESTMENT ACT-REPORTING REQUIREMENTS" and 52.203-15 " Whistleblower Protections Under the American Recovery and Reinvestment Act of 2009 (MAR 2009)." T his acquisition also incorporates 52.217-5 Evaluation of Options, which states: " Except when it is determined in accordance with FAR 17.206 (b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s)." REQUIRED SERVICES : The contractor will be required to provide the services delineated in the Scope of Work CONTAINED IN THIS NOTICE under File #2, which primarily calls for the contractor to perform precast concrete block production and delivery to the Calumet Harbor CDF Dike located in Indiana. CENTRAL CONTRACTOR'S REGISTRATION (CCR) : Contractors must be registered in the Central Contractor's Registration System in order to be awarded the resultant contract. Registration can be completed on-line at http://www.ccr2000.com. APPLICABLE LABOR LAW : The Walsh-Healey Public Contracts Act applies to this acquisition; the applicable Wage Determination is attached hereto. AWARD : The Government reserves the right to make an award on the initial quote without discussions on this procurement. the government intends to award a firm-fixed-priced Commercial Items Contract to the responsive and responsible contractor submitting the lowest aggregate price for all items included in the Bid Schedule. For evaluation purposes, the price for the option will be included in the overall price evaluation.
