- THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." The 57th Component Maintenance Squadron, Nellis AFB Las Vegas, NV, 89191 requires the purchase of Vertical Tank Storage Maintenance. The 99th Contracting Squadron intends to make an award to International Automated Systems, Inc., 1801 Old Highway 8 Suite 121 New Brighton, MN 55112. Interested parties may e-mail brooke.mena@nellis.af.mil or fax 702-652-5405, Attn: Brooke Mena, not later than Monday, 1 July 2009; 4:00 p.m. Pacific Time. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: 22. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within ten days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) International Automated Systems is the only company that provides the parts necessary to maintain the current storage tanks and does not distribute parts to any other companies. Over $800,000 has been invested by the Air Force to install and maintain the current storage tanks. With IAS being the sole provider for maintenance parts, no other company would be able to perform the maintenance needed and new tanks would need to be purchased. Procuring new tanks and maintenance from any other company would require removal of existing tanks and installation of new ones, negating the money that has already been invested. In summary, to procure maintenance from another company would result in substantial duplication of costs, not expected to be recovered through full and open competition.
