DEPARATMENT OF VETERANS AFFAIRSVETERANS INTEGRATED SERVICE NETWORK 6 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 253 (c)(1) 1.The purpose of this memorandum for the record is to document justification for other than full and open competition for the Consolidated Acquisition Service, Veterans Integrated Service Network 6, Department of Veterans Affairs. 2.The undersigned proposes to procure specialized robotic surgical equipment for VA Medical Centers in Durham, NC and Richmond, VA. 3.Intuitive Surgical, Inc. is the manufacturer and distributor for its own unique line of robotic surgical systems, called da Vinci. Systems were procured under sole source authority under contract no. VA246-P-0372 dated 12/29/2008. 4.Under the authority of Title 41 U.S.C. 254 (1) and FAR 6.302-1(b)1(i) other than full and open competition is justified When there is a reasonable basis to conclude that the agencys minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities. In this case, the only equipment for use with the da Vinci system is equipment manufactured and distributed by Intuitive Surgical, Inc. 5.Since the equipment required is only manufactured and distributed by Intuitive Surgical, Inc., they are the only vendor who can provide the equipment which is proprietary to Intuitive Surgical, Inc. 6.Since the system was procured under sole source authority and no other vendor manufactures or distributes the da Vinci equipment, no further market research was required. 7.The price being offered by Intuitive Surgical of $165,600 is considered fair and reasonable in that the unit prices for the various items are the same price as the original equipment purchased under contract. Also, the unit prices are the same as their published commercial catalog prices 8.Market research efforts is described in paragraph 6 above. 9.There are no other facts to support other than full and open competition. 10.As indicated above, no other source is available for procuring this product. Therefore, no other sources were contacted to provide this product. 11.Under the authorities and actions cited above and the fact there is no other available source, there are no actions to be taken to overcome barriers to competition. 12.This justification is accurate and complete to the best of the Contracting Officers knowledge and belief.
