Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Electrical Upgrades - Missile Launch Facilities FA4528-09-C-3011 1. AGENCY AND CONTRACTING ACTIVITY: United States Air Force 5 CONS/LGCA 211 Missile Ave. Minot AFB, ND 58705 2. DESCRIPTION OF ACTION: This is a justification and approval for using a sole source selection under the authority of FAR 6.302-1 "Only one responsible source and no other supplies or services will satisfy agency requirements." 3. DESCRIPTION OF THE REQUIREMENT: The requirement is to upgrade the power equipment that supplies electricity to 28 Launch Facilities in the McLean Cooperative area. 4. STATUTORY AUTHORITY: The statutory authority is 10 U.S.C. 2304(c) (1) as identified in FAR 6.302-1. 5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED: a. 28 sites are currently supplied power by McLean Electric Cooperative using 40 year old equipment and technology. The current system meets industry stands, but does not meet the government's need for "cleaner power" to support missile site technology upgrades. The Cooperative is the owner of the electrical equipment being replaced, and will continue to own and maintain the new infrastructure as well. The Cooperative limits maintenance and repair of its distribution system to its own workforce, therefore, restricting the government's ability to compete the requirement. b. As a result of the current system not meeting the government's need for "cleaner power", additional time, maintenance, and equipment costs are expended to dispatch crews to investigate and repair possible problems. Upgrading this electrical equipment will result in reduced operational/maintenance expenses to the government. 6. EFFORTS MADE TO ENSURE OFFERS FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE: This acquisition is limited to the single Cooperative that supplies power to the Missile Launch Facility. No action was taken to publish this requirement as the acquisition falls under the exception at FAR 5.202(a)(5)..."The proposed contract action is for utility services other than telecommunications services and only one source is available." 7. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE: The significant items on the independent government estimate were compared to the amount charged by local electrical supply companies. It is determined that fair and reasonable pricing in line with general local market pricing, can be expected to be obtained on the requirement. 8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED: Market research was conducted to determine if other than the Cooperative could provide this service. It was determined that the owner of the utility would not allow construction on their distribution system without contracting through them due to regulatory and liability issues. 9. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION: The electrical Cooperative providing power to these remote sites owns the distribution line/system and hence limits the government's ability to compete said requirement. 10. LISTING OF SOURCES THAT EXPRESSED AN INTEREST IN THE ACQUITITION: There were no other sources that expressed interest in fulfilling the requirements of this acquisition. 11. ACTIONS TO REMOVE ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIS OR SERVICES REQUIRED: Based on the cooperative's ownership of the distribution system, there is no way to get around this requirement for sole source acquisition to the respective servicing electrical cooperative. 12.
