Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being solicited and a written solicitation will not be issued. Solicitation number W912l7-09-T-0043 is hereby issued as a Request for Quote. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-34. The Tennessee Army National Guard has the following requirements. This requirement is being advertised as an unrestricted acquisition; the North American Industry Classification System (NAICS) Code is 423990 with a Small Business Size Standard of five hundred (500) employees. All responsible sources determined to be a small business by the Small Business Administration may submit an offer, which shall be considered by this Agency. The following clauses are applicable to this acquisition: FAR 52.212-1 Instructions to Offerors-Commercial Items, FAR 52-212-2 Evaluation Commercial Items, FAR 252.212-3 Offeror Representations and Certifications-Commercial Items, FAR 252.212-4 Contract Terms and Conditions-Commercial Items, FAR 52.212-5 (Dev) Contract Terms and Conditions Required to Implement Statutes or Executive OrdersCommercial Items (JUN 2006) (Deviation) and DFARS 252.212-7001 Contract Terms, Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items (JUL 2006) (Deviation). Quotes are due in this office no later than 4:30 PM Central Daylight Savings time, Monday, July 13, 2009 They can be emailed to Randal.Halbrooks@ng.army.mil or facsimile to 615-313-2659. Offers will be evaluated using the evaluation criteria outlined in FAR 13 and 15. The award will be made to the vendor who offers the lowest priced technically acceptable proposal. Past Performance will not be an evaluation factor in this acquisition. Please provide a quote for the following items: 0001 Hirsbrunner HB-20 tuba with Gig bag, quantity 4 To be determined technically acceptable for this requirement, offers shall provide a product brand name or equal to Hirsbrunner HB-20 with Gig Bag; equal products shall have the following salient physical, functional, or performance characteristics of the brand name item to be acceptable for award. * Exterior wall of tuba shall be silver plated. * Consistent intonation requiring minimal adjustments * Tuba shall be First-line, professional-quality certified by Army band officers, warrant officer bandmasters, or band senior sergeants in accordance with Army Regulation 220-90 paragraph 4-1(b) * Tuba shall produce a consistent quality and characteristic sound throughout the range of the instrument * Tuba shall have front action piston valves designed in such a way as to require minimal maintenance * Tuba shall have 5 valves (4 pistons and one rotary) Vendors who submit an equal product shall submit a sample of the product to Randal D. Halbrooks, 3041 Sidco Drive, Nashville, TN 37204. Sample products shall be shipped in a container that is reusable for return shipping with return address instructions. A fully executed vendor loan test agreement shall be supplied in a packing envelope affixed to the outside of the package; the package shall not be opened and the product shall not be evaluated unless this agreement is properly attached to the outside of the shipping container. Vendors shall contact Randal Halbrooks via email at randal.halbrooks@ng.army.mil to obtain a copy of the Vendor Loan Test Agreement. Army band officers, warrant officer bandmasters, or band senior sergeants shall evaluate this product and certify whether or not it is First-line, professional-quality.This certification shall be a unilateral determination based on their professional ability to evaluate the quality of sound produced by the instrument. Instruments that do not meet the certification of First-line, professional-quality shall not be technically acceptable for award. Sample product of the successful offeror shall be retained as one of the units required. Sample products of the unsuccessful offerors shall be returned after evaluation. AR 220-90 paragraph 41. Musical instruments a. Musical instrument authorizations for Army bands are established by TOE, TDA, or CTA. 16 AR 22090 " 14 December 2007 (1) Additions, deletions, and changes to these documents will be recommended by band commanders and processed through command channels to CAB per AR 7132, and related supply regulations. (2) Additions, deletions, and changes to MTOE and installation TDA will be processed through command channels to the respective Army Command. Army Commands without an assigned SBO will query CAB for assistance. b. Army band officers, warrant officer bandmasters, or band senior sergeants are the only personnel authorized to certify the sufficiency, condition, serviceability, and quality of musical instruments, sound reinforcement systems, recording equipment, musical support equipment, and expendable supplies. (1) First-line, professional-quality musical instruments are required in Army bands. Responsible supporting procurement activities will procure items based on the recommendation of the Army band officer, warrant officer bandmaster, or in the absence of either, the band senior sergeant (see para 14j(2)). Any disagreement between the above personnel and a procurement official over what constitutes first-line, professional-quality musical instruments, electronic equipment, or musical support equipment will be referred to the commands SBO or to CAB, as appropriate, for determination. Delivery shall be made within thirty (30) days after award. Vendors who respond to this solicitation should provide a price per tuba and a total price inclusive of any shipping charges. Please provide Dun and Bradstreet number, tax identification number, CAGE code and a copy of your Offeror Representations and Certifications with quote.
