- ***The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Capres A/S in Lyngby, Denmark for the upgrade of an existing CIPTech Tool. ***Sole Source determination is based on NIST’s requirement for an upgrade to an existing CIPTech Tool. The upgrade includes an upgrade to the retrofit magnet. The upgrade will allow the tool to investigate wider range of sample types. Capres is the only company capable of providing the tool upgrade. Specifically, the unique details of the system are proprietary to Capres. Due to the proprietary nature of this tool, no other vendor would be able to upgrade the tool. As a result, Capres is uniquely qualified to satisfy the Government’s requirement. ***Delivery shall be FOB Destination, Gaithersburg, MD, and is required within 90 days after receipt of order.*** ***The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees.*** ***No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by July 22, 2009.*** A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
