- (I)This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (II)The solicitation document is issued as a request for proposal (RFP). Submit written proposals on RFP number RFQ W91WAW-09-P-0284. (III)The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-30, effective 15 January 2009. (IV)The North American Industry Classification System (NAICS) code is 511210 and the size standard is $7 Million. The acquisition will be issued as unrestricted. (V)This combined solicitation/synopsis is for purchase of the following commercial services: Maintenance in support of PKZIP Software, a proprietary Software License which is a product of PKWARE, INC. This contract provides software from PKWARE, INC., the sole proprietor of the PKZIP data compression algorithm for the mainframe and midrange computer systems. ITEM NO -- SUPPLIES/SERVICES -- QUANTITY -- UNIT- UNIT PRICE - AMOUNT 0001 12 MONTH 0.00 0.00 Software Maintenance of the PKSoftware System in the Pentagon base year. (VI) STATEMENT OF WORK 1.0 Introduction/ Objective Maintenance in support of PKZIP Software, a proprietary Software License which is a product of PKWARE, INC. This contract provides software from PKWARE, INC., the sole proprietor of the PKZIP data compression algorithm for the mainframe and midrange computer systems, which for years has provided the only data compression algorithm to the Data Center, thereby saving the resources that would be required to perform this function manually. 2.0 Tasks/ Requirements The contractor shall: 2.1 Provide software licenses, maintenance releases, and new software releases. 2.2 Provide Licensing of its software, which consist of software maintenance, to include new software releases, problem resolution services, and correction of software errors identified by the Government in the use of the software. 2.3 Provide Software maintenance releases, scheduled by the vendor to correct known software problems and eliminate deficiencies which have been identified or otherwise improve the operational performance and effectiveness of the original software product. Software maintenance may occur at either the Contractors site or at the Pentagon Data Center depending on the nature of the problem and security considerations. In such cases, when the security of the system prevents sending dump information out of the Pentagon Data Center, the contractor would be required to perform maintenance on-site. 2.4 Provide Problem resolution services via a customer hotline/helpdesk, whereby the vendor provides telephonic technical support to users of its software products, in the exploration identification and correction of problems associated with the use of the software. 2.5 Provide Correction of software errors which refers to the vendor providing replacement software code, either through scheduled maintenance releases or one-time emergency releases for sections of current code, which have been determined to contain errors. 2.6 Provide maintenance in support of its PKZIP (Data Compression Algorithm) software to the Pentagon Data Center Services Directorate, its Disaster Recovery sites, its Remote locations, and DOD/NON-DOD customers. 2.7 Provide software support to the Data Center Services customers, which consist of OSD, US Army, US Air Force, and DOD/Non-DOD customers. 2.8 Provide software keys electronically to the Data Center Technical Point of Contact to ensure software is operational (If necessary). 2.9 Provide software maintenance support for software products listed within this contract 2.10 Provide documentation, such as access codes, update versions of software products as requested by the government, and all training and seminar notifications via email. 2.11 The Government will notify the contractor in writing of changes to hardware configurations which may affect the operation of this software. This includes hardware upgrades, which may consist of purchasing of new hardware systems, or any of PKWARE, Inc. software products that are no longer required by the Government. 3.0 Technical POC/ Delivery Location Mr. James Doyle US ARMY INFORMATION TECHNOLOGY AGENCY Data Center Services 6607 Army Pentagon Washington DC 20310 4.0 Period of Performance The Contractor shall provide software support maintenance for a period of one (1) year. The Period of Performance date of award for 1 year. The principal period of maintenance shall be 24 hours per day, 7 days a week, 365/366 days per year, including holidays, this service will be identified as 24x7 maintenance. 5.0 Invoicing Instruction In accordance with DFARS 252.232-7003, Electronic Submission of Payment Request, please submit all invoices using the Wide Area Work Flow (WAWF) online database system. Detrick, MD Base Year: From Date of Award for 1 year (VIII) The provision 52.212-1 -- Instructions to Offerors -- Commercial Items, applies to this acquisition. (IX) The provision at FAR 52.212-2 Evaluation -- Commercial Items applies to this acquisition. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Lowest Price Technically Acceptable (X). The provision FAR 52.212-3, Offeror Representations and Certifications-Commercial Items(By Reference), applies to this acquisition, the offeror must submit a completed copy of with its quote. (XI) The clause at FAR 52.212-4, Contract Terms and Conditions (By Reference), applies to this acquisition. (XII) The clause at FAR 52.212-5 -- Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items is applies to this acquisition (XIII) The Government intends to award a firm-fixed-price order resulting from this combined synopsis/solicitation.
