Description
Contractor to provide NOAA Fisheries AKR Office of Administrative Appeals with recommended decisions per the attached statement of work (SOW) dated 7/9/09. With respect to an appeal assigned to the contractor, the contractor shall review the appeal file; determine if a prehearing conference will materially assist resolution of the appeal and, if so, hold a prehearing conference; conduct a hearing; write a draft recommended decision; review draft with Chief Administrative Judge; finalize a recommended decision. The Chief Administrative Judge will review and approve recommended decisions before they are transmitted to Regional Administrator for the NMFS Northeast Region. NMFS estimates that the average time required to perform these tasks for an appeal is 10 - 15 hours. The recommended decisions shall be written in a format that conforms to guidelines supplied by OAA and will usually be in the range of 5 to 10 pages. The recommended decision will contain findings of fact, which shall be based on testimony and the written record. The recommended decisions will contain conclusions of law, which will be based on applicable laws and regulations. With respect to appeals not assigned to the contractor, the contractor shall perform specific tasks, as assigned by the Chief Administrative Judge, up to a maximum of ten hours. These tasks will require the exercise of legal skills.
