Description This is a combined synopsis/solicitation for commercial supplies prepared in accordance with the format in FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; QUOTATIONS are being requested and A WRITTEN SOLICITATION WILL NOT BE ISSUED. The solicitation number is AG-04M3-S-09-0041 and this requirement is being issued as a Request for Quote. The procurement is a cascading HUBZone small business set-aside. The North American Industry Classification System (NAICS) number is 212319 - small business size standard is 500. This solicitation is being offered by USDA Forest Service, Department of Agriculture, Forest Service, R-6 Blue Mountain Area, PO Box 907, Baker City, OR 97814. If we do not receive enough competition from the HUBZone small business concern set-aside, we will then evaluate quotes and consider for award small business concerns. 1. Scope of Work Contractor shall provide all necessary equipment, personnel, materials and supplies to develop the designated materials source, produce and stockpile the contract quantities (40,000 tons), and reclaim the materials source, in accordance with the specifications. Work shall conform to the performance standards shown in the applicable Performance Based Specifications and shall meet the Acceptable Quality Levels therein. 2. Project Location The Swamp Creek Materials Source is located in T.4N, R.38E, Section 23, at the end of National Forest System (NFS) Road 6400060, approximately 50 miles east of Pendleton, OR. From Pendleton, OR travel approximately 23 miles east on Highway 11 to its junction with Highway 204, near Weston, OR. From the junction of Highway 11 and Highway 204, travel approximately 20 miles on Highway 204 to its junction with NFS Road 64 at Tollgate. From the junction of Highway 204 and NFS Road 64, travel north approximately 6 miles on NFS Road 64 to its junction with NFS Road 6400060. Turn left onto NFS Road 6400060 and travel approximately ½ mile to the Swamp Creek Materials Source. 3. FAR 52.211-10 Commencement, Prosecution and Completion of Work (APR 1984) The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than September 30, 2009. Estimated start date is September 1, 2009. 4. Safety Mobile rock crushing operations are inherently hazardous. The Contractor shall ensure that all personnel involved with this contract are familiar with safety procedures relative to operating in materials sources, are supplied with and using personal protective equipment that is in good working condition, are adequately trained in operation of equipment, are trained to recognize and respond correctly to hazards, have current first-aid training, and are active participants in regular safety briefings. The Contractor shall ensure all equipment is in good working condition, and all guards and safety devices are in place and serviceable. Hazards associated with mobile crushing operations include, but are not limited to: excessive noise, excessive dust and airborne particulates, rapidly moving parts that can snag loose clothing or human extremities, pinch points, equipment subjected to violent shock and extreme wear rates, resulting in failure, spilled lubricants, resulting in slip hazards, and cords and conduits presenting trip hazards. A site specific safety plan shall be submitted to the CO at the Post Award conference. 5. AGAR 452.236-72 Use Of Premises (NOV 1996) a. Before any camp, quarry, borrow pit, storage, detour, or bypass site, other than shown on the drawings, is opened or operated on USDA land or lands administered by the USDA, the Contractor shall obtain written permission from the Contracting Officer. A camp is interpreted to include a camp site or trailer parking area of any employee working on the project for the Contractor. b. Unless excepted elsewhere in the contract, the Contractor shall (i) provide and maintain sanitation facilities for the work force at the site and (ii) dispose of solid waste in accordance with applicable Federal, State, and local regulations. 6. AGAR 452.236-73 Archaeological or Historical Sites (FEB 1988) If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately. 7. AGAR 452.236-77 Emergency Response (NOV 1996) A. Contractor's Responsibility for Fire Fighting 1. The Contractor, under the provisions of FAR clause 52.236-9, PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES AND IMPROVEMENTS, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work. 2. The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor's agents or employees. B. Contractor's Responsibility for Notification in Case of Fire The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site. C. Contractor's Responsibility for Responding to Emergencies When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site or emergency work (anticipated to be restricted to fire fighting). An equitable adjustment for the temporary use of employees and equipment will be made under the Changes clause, FAR 52.234-5.
