- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The California Air National Guard 129th Rescue Wing intends to establish one or more Blanket Purchase Agreements (BPA) with hotels in the Moffett Federal Airfield area to satisfy lodging requirements for people during Unit Training Assembly (UTA) weekends and Annual Training dates. The scope of this Blanket Purchase Agreement shall be limited only to the rental of rooms for the period of 01 August 2009 through 30 September 2013 if and when requested by the Contracting Officer or his authorized representatives (identified in the call authorization letter). Charges against this Blanket Purchase Agreement will be for rooms only; all other charges will be the responsibility of the individual concerned. The issuance of individual calls against this Blanket Purchase Agreement will be made in accordance with the Federal Acquisition Regulation parts 6 and 13. Rooms shall meet minimum commercial standards and include linen service, in-room bathroom/shower facilities, heated/air conditioned and present a clean appearance. The government will be obligated only to the extent of authorized purchases actually made under this blanket purchase agreement by authorized personnel. The Contracting Officer will provide the Contractor with a list of names of the individuals authorized to place calls against this agreement. The Contractor will be required to acknowledge receipt of this list and return a copy of the list to the Contracting Officer for the file. Only calls made be personnel authorized in writing by the Contracting Officer will be honored against this Blanket Purchase Agreement. THIS AGREEMENT IS NOT A CONTRACT. The government assumes no liability for willful damage caused by individuals occupying rooms. The Contractor is responsible for the collection of money for phone calls, food charges, bar and similar incidental charges from the room occupants. The Government is only responsible for those charges included in the room price. All other charges must be collected from the occupant of the room. Prices for rooms furnished to the government under this Blanket Purchase Agreement shall be as low or, lower than those charged the suppliers most favored customer for comparable quantities under similar terms and conditions, in addition to any discounts for prompt payment. Prices will be in accordance with the approved price list that it is in effect when the call was made. This agreement will be in effect for a period not to exceed five (5) years commencing on the date identified in block 3 (DD1155) or until such time either party to this agreement requests that it be canceled (30 day notice required). 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) Award will be made to the Lowest Price Technically Acceptable offeror. In order to be technically acceptable, offerors must meet the following minimum factors or salient characteristics: 1. Have a 3-Star or higher rating based on Hotels.com rating system. 2. Must be within 10 miles from Moffett Field, CA 94035. 52.212-1 Instructions to Offerors Commercial items (Jun 2008) 52.212-3, Offerors Representations and Certifications Commercial Items the offeror shall complete only paragraph (l) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (k) of this provision. 52.212-5, Contract terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items applies to this acquisition.
