- This combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The Request for Quote (RFQ) number is RFQ-C003289, and is being conducted as a 100% Small Business Set-Aside, under the procedures of Part 12 and 13, test program, for Commercial Drivers License (CDL) course for ten (10) employees. The North American Industrial Classification System (NAICS) number is 611310, the size standard is $7.0 million. The RFQ incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2005-34. The Federal Bureau of Investigation (FBI) intends to award a firm-fixed price type contract for a CDL course for ten (10) employees. Obligation of funds will be through an individual purchase order, or through the Government Purchase Card program. The item to be supplied is: CDL Course for ten (10) employees. The CDL driving course shall be conducted at the FBI Academy located in Quantico, VA, and the maximum number of students for each session with be five (5) trainees. The Contractor shall provide a course that is nine (9) days in length (beginning on a Saturday, and ending on the next Sunday); eight (8) to twelve (12) hour days, based on instructor's determination of student needs; number of instructors to students per session is a 2 ½ to 5 ratio; and the Contractor shall provide all training material (i.e. hand outs, Power Point Presentations, overheads, and text books.) The FBI will provide the following: two (2) tractor with condo sleepers, two (2) trailers (48 foot), fuel for the tractor trailer trucks, ten (10) road cones, a training area to act as a range for training the students behind the wheel, classroom to accommodate the classroom instruction, overhead projector for presentations, and evidence that all attendees will have Class A permits 30 days prior to the start of class, if possible. The Contractor shall provide, in their quotes, at least four tentative session schedules to begin before September 15, 2009. All quotes will be considered. The provision at FAR Clause 52.212-1, Instructions to Offerors, and addendum is incorporated. ADDENDUM to 52.212-1, modify (b) Submission to offers: shall be forwarded to the contracting officer, Ms. Theresa M. Powell, via the Internet at Theresa.Powell@ic.fbi.gov. The contractor shall provide the FBI with three (3) points-of-contact from previous contracts, either Government or Commercial, for the purpose of evaluating Past Performance. All quotes are due by 1:00pm, EDT, July 28, 2009. Delivery of items shall be thirty (30) days after receipt of order. Incorporated by reference are the FAR Clauses 52.212-4, Contract Terms and Conditions (MAR 2009), and 52.212-5, Contract Terms and Conditions Required to Implement Statutes and Executive Orders (JUN 2009), Subsection (a), (b) 1, 16-20, (d), and (e). ADDENDUM to Clause 52.212-4, add 52.233-3-PROTEST AFTER AWARD (AUG 1996); 52.216-19-ORDER LIMITATIONS (OCT 1995); 52.233-2-SERVICE OF PROTEST (SEP 2006). The Department of Justice (DOJ), Justice Acquisition Regulation Clauses, 2852.233-70-PROTESTS FILED DIRECTION WITH THE DEPARTMENT OF JUSTICE (JAN 1998). The FBI's ombudsman for this solicitation is Mr. Richard A. McFeely, Federal Bureau of Investigation, 935 Pennsylvania Avenue, Washington, DC 20535. Mr. Walter V. Meslar, Head of Contracting Activity, Federal Bureau of Investigation, 935 Pennsylvania Avenue, Washington, DC 20535-0001, shall serve as the FBI's contact in accordance with 52.233-3-PROTEST AFTER AWARD (AUG 1996). ADDENDUM to Clause 52.252-5-AUTHORIZED DEVIATIONS IN CLAUSES, is incorporated by reference and applies to FAR Section 9.104-1, and Clause 52.212-3, Offeror Representations and Certifications apply, and can be found at www.acqnet.gov. Each offer shall include a completed copy of 52.212-3 with their quote. FAR Clause 52.212-2, Evaluation-Commercial Items (JAN 1999) is incorporated by reference and applies to this acquisition. ADDENDUM 52.212-2 (a)-Award will be based on price. The following factors shall be used to evaluate offers: Price, Technical, and Past Performance. Technical and past performance, when combined, are significantly less important than cost or price. The FBI will award to the offeror who provides the Best Value to the Government, price and other factors considered. Past Performance will be based on telephonic performance evaluations received from previous contacts provided in the quote. Any vendor not having Government or Commercial experience will be rated as "Neutral." Offerors must acquaint themselves with the regulations concerning Commercial Item acquisition contained at FAR Subpart 12 and must ensure that all Representations and Certifications (located on the Internet) are executed and returned as required in this synopsis/solicitation.
