DEPARTMENT OF VETERANS AFFAIRSLOUIS STOKES CLEVELAND VA MEDICAL CENTER VISN 10 Contracting Activity 10000 Brecksville Road Brecksville, OH 44141-3204 JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, the use of other than full and open competition for the proposed procurement action is authorized pursuant to the authority of 41 U.S.C. 253(c)(1), only one responsible source. JUSTIFICATION 1.Identification of Agency and Contracting Activity. The Louis Stokes Cleveland Department of Veterans Affairs Medical Center, 10000 Brecksville Road, Brecksville, OH 44141-3204, Visn 10 Contracting Activity. 2.Nature/Description of Action. This activity proposes to procure one LGP HCTS2000-MK2 sorter for the Cleveland VAMC's Pathology department. 3.Description of Supplies/Services. This requirement is to allow the Cleveland VAMC's Pathology Department to maintain the level of patient care services required by the Medical Center's Quality Assurance Management. The LGP HCTS2000-MK2 sorter is designed for sorting closed primary samples tubes used in medical laboratories using information in the barcode or through queries to the LIS. The sorter helps optimize the work flow in the Pathology Department by freeing up laboratory personnel so they can concentrate on other tasks. The quoted cost for this equipment is $104,200.00 4.Identification of Statutory Authority. The statutory authority permitting only one responsible source is 41 U.S.C. 253(c)(1). 5.Rationale in support of citation in Paragraph 4 above: Description of contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: A small business, "LGP Consulting Inc" is the manufacturer of the "LGP HCTS2000-MK2 sorter. The sorter would improve the efficiency of laboratory operations, prevent delays in patient testing which has in the past had a negative impact on patient care. This equipment is necessary to improve quality service for veterans at the VA Medical Center. 6.Federal Business Opportunities (Fedbizzops) Announcement/Potential Sources. This acquisition will be announced on Fedbizopps as Intent to sole source. A synopsis will be posted to Fedbizopps as authorized by FAR Subpart 5.201. 7. Determination of a Fair and Reasonable Cost The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable, the price is offer to the government ($104,200.00) is over a 10% reduction from its commercial price on the open market ($116,000.00). This company original quote was given January 20, 2008 ($104,668.00), which included a freight charge of $468.00, the company reduced it freight charge to $198.00, and stand by the January 2008 equipment price quote. 8. Description of Market Survey. A search of VetBiz, VA Advantage, GSA Advantage and NAC fail to reveal any potential vendors. An Internet search revealed only two vendors: LGP Consulting Inc. (the manufacturer) with a discount price of $104,200.00, and Fisher Scientific (a distributor) with the market price of $116,000.00.
