Attachment B - Additional Terms and Conditions for CFOM-09-SO-0177 Attachment A - Statement of Work for CFOM-09-SO-0177 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation number CFOM-09-SO-0177 is issued as a Request For Quotation (RFQ) under the Test Program for Certain Commercial Items (FAR Subpart 13.5). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-34. This procurement is not a set-aside. All responsible sources may submit a quotation. The NAICS code for this acquisition is 541410 with a small business size standard of $7.0 million. The Government intends to award one contract resulting from this solicitation. As described in the Statement of Work, Attachment A to this combined synopsis/solicitation, the contractor shall furnish, and utilize, Computer Aided Facility Management System (CAFM) software for real-time management and reporting of occupancy, square footage, space type and other relevant CFTC facility information. The period of performance will be one year from the effective date of award, with four additional one year options for system maintenance and technical support. All deliverables shall be shipped F.O.B. Destination. The provision at 52.212-1, Instructions to Offerors—Commercial, applies to this acquisition. There are no addenda applicable to the provision. The provision at 52.212-2, Evaluation—Commercial Items, is applicable to this procurement. The specific evaluation criteria to be included in paragraph (a) of that provision are: (1) Merits of the Proposed CAFM System; (2) Corporate Experience and Past Performance; (3) Qualifications of the Proposed Key Person; and (4) Price. The evaluated price will be the sum of the proposed not-to-exceed amount for the anticipated level of effort (840 hours) and estimated travel (if applicable) for the base year, all license costs, and the price of system maintenance/technical support for each of the potential 5 years of the contract. As part of this evaluation, CFTC may also conduct a price realism analysis. CFTC may award the contract to other than the lowest priced offeror. The above technical criteria are listed in declining order of importance. From the standpoint of the relative importance of price to the technical criteria, the technical criteria, when combined, are significantly more important than price. However, as the merit of technical factors in competing quotations approaches equality, price will become increasingly more significant as an evaluation factor. Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items, with its quotation. The clause at 52.212-4, Contract Terms and Conditions—Commercial Items, applies to this acquisition. There are no addenda applicable to the clause. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders—Commercial Items, applies to this acquisition. Additional terms and conditions to be included in the contract are described in Attachment B to this combined synopsis/solicitation. Quotations shall include the following: (1) Merits of the Proposed CAFM System – Provide specific details of your proposed CAFM system for meeting CFTC’s requirements, together with technical documentation sufficient to demonstrate how your proposed solution will meet CFTC’s needs. Discuss the specific system modules being proposed, if applicable, as well as other modules that would be available to the Commission. Additionally, please provide details of any recommended hardware (i.e., equipment) configurations and/or requirements necessary to support the proposed solution. (Note: This section of the quotation shall be limited to ten (10) pages, using 12 point or larger font for text, with a maximum page size of 8.5”x 11”.) Additionally, describe the usage authorized by each license (e.g., number of users) that will be provided for the system. Describe any and all additional terms and conditions that would apply to the licenses and technical support (Note: The Commission may consider a proposed different level of technical support than what is stated in the Statement of Work, if it is determined to be in the Government’s best interests). Provide a copy of the maintenance agreement, if any, that would apply to the contract. CFTC reserves the right to require a demonstration of the proposed CAFM system; (2) Corporate Experience and Past Performance – Provide information on five (5) projects similar in scope, magnitude and complexity to this project that are currently being completed or have been completed by your firm within the past two (2) years. For each project, also provide point of contact information (i.e., name, title, telephone number and fax number) for contractual matters (e.g. Contracting Officer) and technical performance (e.g. COTR). (Note: The description of each project shall be limited to one (1) page, using 12 point or larger font for text, with a maximum page size of 8.5”x 11”.); (3) Qualifications of the Proposed Key Person – Furnish a resume for the individual proposed to perform the implementation and full-time support described in the Statement of Work for the base year of the contract. The resume shall show complete work and education history, and demonstrate the experience and qualifications necessary to successfully perform the work. The resume shall also include three (3) references from other organizations (i.e., not the offeror) that can discuss the individual’s experience and performance. If the proposed individual is not currently employed by the prime, a teammate or proposed subcontractor, provide a letter of commitment signed by the individual that clearly states his or her availability to work on this project in the event of award. (Note: The resume shall be limited to two (2) pages, using 12 point or larger font for text, with a maximum page size of 8.5”x 11”.); and (4) Price – The quotation shall contain a not-to-exceed amount and firm-fixed price for the base year, and a firm-fixed-price for each of the four (4) option years. For the base year, the quoter shall breakout its not-to-exceed amount by illustrating the labor hours stated in the Statement of Work (i.e., 840 hours) and the fully-loaded labor rate for the individual proposed, as well as its detailed travel estimate (if applicable). Also for the base year, the firm-fixed-price portion shall be broken out by illustrating all other applicable system-related items (i.e., software/licenses and maintenance/support) for the proposed CAFM solution. For each option year, breakout the proposed firm-fixed-price by illustrating all system-related items (i.e., software/licenses and maintenance/support). Also, if additional system modules are available, but have not been proposed as part of the solution, please also provide their pricing (i.e., license and annual maintenance costs) for informational purposes only. The CFTC expects to evaluate quotations and award a contract without conducting discussions and/or soliciting quotation revisions. Therefore, the offeror’s initial quotation should contain the offeror’s best terms from a price and technical standpoint. However, CFTC reserves the right to conduct discussions if later determined by the CFTC Contracting Officer to be necessary. All questions regarding this combined synopsis/solicitation shall be submitted to the Contracting Officer via email to wroberson@cftc.gov, by 12:00 p.m. local (Washington, DC) time on July 28, 2009. CFTC expects, but does not guarantee, to answer questions submitted by this time. Questions, if answered, will be responded to in the form of an amendment to this combined synopsis/solicitation. Quotations are due no later than 3:00 p.m. local (Washington, DC) time on August 4, 2009. The quotations shall be submitted to the attention of Contracting Officer William M.
