Description: This is a combined synopsis/solicitation for commercial item services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This RFQ and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 05-35. This solicitation is set-aside for certified HUBZone small businesses, NAICS 238910, Site preparation contractors, with a small business size standard of $14.0 million average annual gross receipts for the past three years. The National Park Service encourages the participation of disadvantaged and women-owned businesses. The Government intends to issue a firm-fixed price requirements contract to the responsible offeror whose total offer is the most advantageous for the Government, price and other factors considered. I. BACKGROUNDThe National Park Service manages paved and gravel roadways within the Stehekin District of North Cascades NPS Complex and Lake Chelan National Recreation Area. We also have occasional needs for heavy equipment to perform a variety of maintenance tasks. This contract will establish rates and procedures for heavy equipment rental with operator to assist with NPS operations. II. SCOPE OF WORK A.Contractor will provide all needed equipment, labor, and transportation required to do the work. All equipment to be called out and tasks to be performed shall be at the request of the Contracting Officer or a duly authorized Contracting Officer's Representative (COR). B.The Contractor shall operate their own construction equipment to perform a variety of services such a road repair, maintenance, and emergency services including, but not limited to, hauling material, grubbing, establishing rough grade, grading, ditching, demolition projects, shoreline erosion control and utility projects. C.All work shall be in accordance with the terms and conditions, and specifications shown below. For work not specifically covered in the following specifications, performance of the work required will be as directed by the Contracting Officer's Representative.D.The operator may assist NPS crews in establishing reroutes of roads and water crossings following major storm events.E.The work required by this contract represents requirements in excess of the quantities that the government may itself perform. All work will be ordered and directed by the COR and shall be accomplished within the times specified for each task.F.This commercial-item requirements contract will remain in effect for up to 12 months from date of award. Estimated total contract value is between $25,000 and $100,000. III.LOCATIONAll work required by this contract will be performed in Lake Chelan National Recreation Area, Stehekin District, North Cascades National Park Service Complex. All equipment and personnel must be staged in Stehekin during the life of the contract. Stehekin is a remote community located at the north end of Lake Chelan, approximately 50 miles from Chelan, Washington. The Stehekin valley is isolated; the roads do not connect with any highway system. Stehekin is accessible from Chelan only by boat or barge; all materials and equipment will need to be barged. Within the Stehekin valley, the project area can be reached on roads suitable for hauling heavy equipment. Lodging and meal services are available on a limited basis. Cellular phones do not work and there is no public Internet access. Information about Stehekin can be found at: www.nps.gov/lach, www.stehekinchoice.com, www.stehekinvalley.com, www.golakechelan.com or www.stehekin.com. All work will be performed on 1) native or aggregate single-lane roadbeds associated with the Stehekin Valley Road, 2) areas nearby and associated with the Stehekin River and other waterways, or 3) on park lands adjacent to Lake Chelan and may include in-water work for erosion control, other resource projects and utility work (trenching and backfill). IV.EQUIPMENTRental equipment includes the following types which will be available with operator. You may offer other similar or complementary equipment as well:a)Excavator w/thumbb)10-cubic yard dump truck(s)c)Front-end loaderd)Motor gradere)Uniloaderf)Water tankerg)Semi-tractorh)20-ton tilt-bed equipment traileri)Tractor w/20 yd end dumpj)Rock screening machinek)Air compressorl)Backhoe/loader All equipment shall have bio-preferred hydraulic fluid installed for any work done under this contract. Products, information, and sources may be viewed at http://www.biopreferred.gov/Catalog.aspx (search on keyword "hydraulic fluid"). The wages paid to the operator of this equipment are subject to the Service Contract Act. Wage determination #2005-2565, Revision 7 (dated 06-02-2009) can be viewed at http://www.wdol.gov or from the contracting officer. The pertinent wage classification is 23440 - Heavy Equipment Operator ($22.60 per hour). According to the SCA Directory of Occupations, "The Heavy Equipment Operator operates heavy equipment such as cranes, clamshells, power shovels, motor graders, heavy loaders, carryalls, bulldozers, rollers, scrapers, and large industrial tractors with pan or scrapper attachments. Equipment is used to excavate, load, or move dirt, gravel, or other materials. Operator may read and interpret grade and slope stakes and simple plans, and may grease, adjust and make emergency repairs to equipment." You may offer the same or other equipment for "bare" rental (without operator), priced at a monthly, weekly, daily, or hourly rate. Equipment offered for rent shall be in good operating condition and free of leaks. The following provisions shall apply to bare equipment rental.A.The Contractor hereby leases the equipment listed above to North Cascades National Park Service Complex (otherwise known as the Government) for project work at various locations within the Stehekin valley. The Government intends to lease the equipment for use and operation by Government personnel. B.The Government assumes the risk for Government-caused loss, damage, or destruction of equipment rented under this contract provided that no reimbursement will be made for loss, damage, or destruction when due to ordinary wear or tear, or negligence of Contractor or Contractor's employees caused or contributing to loss, damage or destruction, subject to "Availability of Funds" in accordance with the Anti-Deficiency Act, 31 U.S.C. Section 1341, 1350.C.Equipment furnished must be in acceptable condition and will be subject to a Government pre-inspection. The government reserves the right to reject equipment that is not in accordance with the specifications contained herein, or which is not in a safe operating condition. All equipment shall be furnished with bio-based hydraulic fluid.D.The Government agrees to use and care for the equipment in a careful and prudent manner, to pay for all fuel, oil and grease, and to perform needed preventive maintenance while the equipment is in the possession of the Government. Repairs to equipment due to pre-existing conditions or excessive wear and tear shall be made and paid for by the Contractor. The Government may, at its option, elect to make such repairs when necessary to keep the equipment operating. The cost of such repairs will be deducted from payment to the Contractor. The Contractor shall provide operator manuals for the Government's use during the rental period.E.The equipment shall be returned to the Contractor in as good a condition as received, reasonable wear and tear excepted. If, upon its return to the Contractor, the equipment is not in as good condition as described above, the Contractor shall contact the Contracting Officer and discuss the problem(s) before any repairs are made. If in agreement, the Contractor may repair it and the Government may pay the cost of any such repairs at the Contractor's regular shop rate.F.The Government agrees to cooperate, to the extent allowed by law, in the submission of claims pursuant to the Federal Tort Claims Act against the United States for personal injuries or property damage resulting from the negligent or wrongful act or omission of any employee of the United States while acting within the scope of his employment, arising out of this agreement.G.The Government shall not, unless with the written consent of the Contractor, install any accessories or devices on the equipment if such installation will impair the originally intended function or use of the equipment. All accessories or devices fixed to the equipment shall automatically become the property of the Contractor unless such part or device can be removed without in any way affecting the originally intended function or use of the equipment. Any damage to the equipment caused by the removal of such accessories or devises shall be repaired at the Contractor's expense.H.The Government shall comply with, and conform to, all applicable laws and regulations relating to ownership, possession, use and maintenance of the equipment.I.The Government shall, when requested, advise the Contractor of the location of the equipment. The Contractor and its representatives may, for the purpose of inspection, at all reasonable times, enter upon any job, building or place where the equipment is located. The Contractor may remove the equipment without notice to Government if, in the opinion of the Contractor, it is being used beyond its capacity or in any other manner improperly cared for or abused. The removal and transportation of the equipment without prior agreement shall be at the Contractor's expense.J.The Government agrees that the Contractor may assign this contract and all rights, title and interest f the Contractor in and to the equipment, and all rents due or to become due to Contractor hereunder and the Government agrees to recognize such assignmentK.This is an agreement for rental only and nothing herein shall be construed as conveying to the Government any right, title or interest in or to any item of equipment leased hereunder, except as a lessee.L.Rental payments shall be made upon the submission of proper invoices or vouchers identifying each item of equipment invoiced for. Rent shall accrue from the beginning of this contract, or from the date each item of equipment is delivered to the Government and shall continue to accrue until equipment is released for return to the Contractor's place of business. Rent shall not accrue for any equipment that the Contracting Officer determines is not in good operating condition and does not comply with the requirements of this contract, until such time that the defects are corrected or the item of equipment is replaced by the Contractor. V.GRADING AND DITCHINGA.The work consists of reconditioning the surface of existing and new rerouted roadways and routine maintenance on various types of drainage ditches to provide a waterway which is unobstructed. Drainage ditch maintenance is limited to materials contained within the ditch and not on the shoulder or travel way, but may extend three feet above the flow line on the backslope. All roads shall remain open to traffic with no more than 15 minutes maximum delay time.B.Surface grading shall be performed during timeframes acceptable to the Contracting Officer or the Contracting Officer's Representative. Contractor shall commence work within five (5) days after receiving a verbal request by the CO, COR, or other ordering official designated by the Contracting Officer.C.The existing traveled way, including turnouts, shall be bladed and shaped to produce a surface which is uniform, consistent to grade, and crowned or cross-sloped as indicated by the quarter inch per foot of width. Surface materials shall be thoroughly loosened to no less than two-inch depth or the depth of potholes or corrugations. Scarification to facilitate cutting to the full depth of potholes or corrugations may be elected by the Contractor but will be considered incidental to grading. Scarification shall not go deep enough to cause contamination of the surfacing. The road will be maintained at an average width of 14 feet.D.Surface grading shall be performed only when sufficient moisture is present to prevent segregation.E.Existing native, rock, or aggregate surface drainage dips shall be shaped incidental to grading to divert surface runoff to existing outlet devices, ditches, and discharge locations.F.The Contractor shall establish a grading pattern which provides a uniform driving surface, retains the surfacing on the roadbed and provides a thorough mixing of the materials within the completed surface width. Upon final grading, no disturbed rock shall protrude more than two-inches above the adjacent surface unless otherwise provided in the contract. Material not meeting this dimension shall be removed and placed outside the roadbed so as to not obstruct drainage ways or structures. This material may be scattered off the roadbed if there is free drainage. Removal of oversized materials may require hand labor to meet specifications.G.Roadway slopes shall not be undercut. At intersections, the roadbeds of side roads, which are not closed or restricted from vehicular use, shall be bladed to assure smooth transitions.H.Materials resulting from work under this section shall not be allowed to remain on or in structures, such as bridges, culverts, cattle guards, or drainage dips. All road drainage structures 36" in diameter and smaller shall be hand cleaned, including cutting of brush within a six-foot radius of the culvert inlet.I.Ditches shall be maintained by removing rock, soil, wood, and other materials. Upon completion, the maintained ditch shall be of the same character as abutting segments that we not required to be maintained.J.Suitable material removed from the drainage ditch may be blended into existing native road surface and shoulder or placed in designated berm. Material from ditch pulling operations may be blended into and across aggregate surfaced roads unless staked or marked otherwise on the ground. No material shall be pulled and bladed across bituminous surfaced roads. With advanced approval of the COR, excess materials shall be deposited outside the roadbed, along the fill slope, so as not to obstruct drainage structures.K.Furrow ditches shall be reshaped and blockage removed except that blockages previously placed to divert water from the ditch into culverts or other drainage structures shall remain.L.Limbs and wood chunks in excess of one-foot in length or three-inches in diameter shall be removed from ditches and placed outside the roadway.M.Paves surfaces shall be cleaned of all materials resulting from Contractor's ditch maintenance work.N.Lead-off ditches shall be shaped to drain away from the traveled way. VI.CLEARING/GRUBBING/HAULINGThis section consists of providing labor and equipment to assist NPS in establishing reroutes along the Stehekin Valley Road. Specific tasks include:AHauling materials as directed by the COR, including but not limited to riprap, base material, stumps, logs and culverts to identified locations.B.Clearing stumps and vegetation debris from route as directed by the COR.C.Using furnished equipment to establish rough grade using government-provided staking and control points as reference. VII.WATERA.The work of this section consists of providing manpower and equipment to furnish an adequate water supply, hauling, and applying water.B.Suitable and adequate water sources are available in the contract area. Water sources will be selected by the Contractor and submitted to the COR for approval.C.Mobile watering equipment shall have watertight tanks of known capacity.D.Positive control of water application is required. Equipment shall provide for uniform application of water without ponding or washing.E.An air gap or positive anti-siphon device shall be provided between the water source and the vehicle being loaded if the vehicle has been used for other than water haul, the source is a domestic potable water supply, or the water is used for tank mixing with any other materials. VIII.EROSION CONTROL AND UTILITY TRENCHINGThis section consists of providing labor and equipment to assist the NPS in projects along the shoreline of Lake Chelan and assisting in the construction or rehabilitation of utility trenching within the Stehekin District.A Using construction drawings or sketches assist in constructing erosion structures along the shoreline of Lake Chelan. Structures may be constructed of rock, logs or a combination of both. B. As directed trenching for utility systems within the Stehekin District, these may be for water, sewer, phone or gas utilities. IX.SAFETY AND ACCIDENT PREVENTIONA.The Contractor is required to establish an effective accident prevention program and providing a safe environment for all employees, visitors, and park personnel.B.The Contractor shall hold monthly safety meetings and provide notification to the COR of the day and time of the meetings so that he/she may attend.C.Upon request, Contractor must submit proof of employees' qualifications to perform assigned duties in a safe manner.D.In the event of conflicts between Federal, State, and Local safety and health requirements, the most stringent shall apply.E.Equipment or tools must meet OSHA requirements. Failure to comply with the requirements of this section may result in suspension of work.F.All accidents must be reported to the COR immediately. A reportable accident is defined as death, occupational disease, traumatic injury to an employee or the public, property damage in excess of $100, and fires. Form DI-134 must be completed and submitted to the COR within three days of an accident. Forms are available from the COR.G.Personal protective equipment must be maintained in a serviceable condition and checked daily. Clean, sanitize, and repair equipment as appropriate.H.Contractor is required to provide all necessary traffic barriers, traffic control signs, markers, and flaggers when required during operations. Traffic control for occupied work areas shall be in accordance with National Standards contained in the Manual of Uniform Traffic Control Devices (MUTCD).I.Contractor's vehicles and machinery operating on or from the travel way or road shoulder shall have flashing lights, strobes, or rotary beacons operated continuously while work is in progress. Truck headlights shall be on while operating. Backup horns shall be required on all self-propelled equipment in excess of 8000 lbs. gross weight.J.Fluid spill kit shall be located at all work sites capable of handling a minor spill. X.NOXIOUS WEED PREVENTIONTo prevent the introduction of the seeds from noxious weeks into Stehekin valley or onto NPS land, the Contractor shall wash all mechanized equipment thoroughly before transport via barge. This includes the removal of all soil, seeds, vegetative matter or other debris that could contain or hold seeds. Diffuse or spotted knapweed or rush skeleton weed are the primary noxious weeds of concern. The Contractor shall employ whatever cleaning methods are necessary to ensure compliance with the terms of this provision, and shall notify the NPS prior to moving each piece of mechanized equipment into Stehekin valley. Cleaning of equipment shall not occur on NPS land. Notification will include identifying the location of the equipment's most recent operation. The NPS will inspect each piece of equipment prior to its being placed into service If a piece of equipment fails the inspection, the Contractor will be responsible to perform whatever methods are necessary to pass upon re-inspection and will bear all costs. XI.INVOICESA.Payment will be made at the awarded rates for the actual number of hours worked to the nearest quarter hour. B.Invoices shall contain the following information: Contractor's name and address, Contract number, Date of event and/or description of work, Description of equipment used, Number of hours for each piece of equipment rented with operato, Rental period (e.g. hour, day, week, month) for bare rentals, Total amount of invoice XII.PROPOSAL SUBMITTALSOfferor shall provide:A.At least three references for recently-completed contracts, including company name, contact person, phone number, e-mail address (if available) and physical address. Highlight federal government contracts and work in remote areas. References must be available for contact by NPS. Proposals shall be considered non-responsive of NPS is not able to readily contact references.B.A list of operated equipment available, with make, model, year of manufacture, and hourly operated rental price for each. Pricing shall be FOB destination, Stehekin, Washington.C.A list of bare equipment available, with make, model, year of manufacture, and monthly, weekly, daily, and hourly rental price for each. Pricing shall be FOB destination, Stehekin, Washington.D.A list of the operators' name(s), experience, and training, as well as any pertinent certifications.E.Include a list of fuels used in this equipment and their current price(s). An increase or decrease of greater than $0.30 per gallon, sustained for longer than 30 days, may trigger a negotiated adjustment in the operated equipment rental prices. XII.DETAILSPrior to submission of an offer, the offeror must:1.Maintain a current profile in the Central Contractor Registration database (www.ccr.gov); and2.Have completed the online submission of annual representations and certifications (https://orca.bpn.gov). The deadline for receipt of quotes is August 4, 2009, at 4:30 pm. Offers shall be signed by an official authorized to bind your organization. Offers may be submitted on letterhead or the Standard Form 1449, and must include, at a minimum:1.Completed price schedule;2.A statement indicating if you prefer payment by MasterCard or direct deposit (net 30 days);3.Contractor remittance address, DUNS number, and federal tax identification number;4.Name, phone number, and address of your point of contact; 5.Signature of official authorized to bind your organization; 6.The proposal submittals identified above.Submit two (2) complete proposals.
