Description
DEPARTMENT OF VETERANS AFFAIRSVETERANS INTEGRATED SERVICE NETWORK 6 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 253 (c)(1) 1. CONTRACTING AGENCY: The VISN 6 Centralized Acquisition Service, in support of the Department of Veterans Affairs Medical Center, Richmond, Virginia, intends to execute a Justification for Other Than Full and Open Competition for the following procurement. 2. DESCRIPTION OF ACTION: The undersigned proposes to procure a K4b2 Pulmonary Gas Exchange System and supplies for the Richmond VA Medical Center. 3. DESCRIPTION OF SUPPLIES/SERVICES: The requested Pulmonary Gas Exchange System is needed for merit review grants measuring obesity and body composition in spinal cord injury patients. 4. AUTHORITY CITED: Under the authority of Title 41 U.S.C. 254 (1) and FAR 6.302-1(b)1(i) other than full and open competition is justified when there is a reasonable basis to conclude that the agencys minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier. The make and model of the Pulmonary Gas Exchange System from CosMed USA provides the technology and dimensions required by the VA to measure cardio-respiratory response in the field without any limitations. It is distinctive in that it has telemetry transmission capability, as well as an integrated GPS system. The unit also has the distinguishing characteristic of being very lightweight (800 g) and completely portable since it does not need to be tethered to a PC. 5. REASON FOR AUTHORITY CITED: CosMed is the manufacturer and sole distributor of the K4b2 Pulmonary Gas Exchange System. The unique features of this unit offer the transmission flexibility and mobility needed for metabolic testing in spinal cord injury patients. 6. EFFORTS TO OBTAIN COMPETITION: An Intent to Sole Source was posted on FedBizOpps for 15 days. No inquiries or responses were received. 7. FAIR AND REASONABLE PRICE DETERMINATION: CosMed USA is giving the VA a 15% discount on the K4b2 Pulmonary Gas Exchange System and calibration syringes, and a 10% discount of the other supplies for a savings of over $5,000.00. It has therefore been determined that the cost to the VA is fair and reasonable. 8. MARKET SURVEY/RESEARCH: Market research was conducted and products were researched on the world-wide web including GSA Advantage and medcompare.com. I could not find any Pulmonary Gas Exchange units with the same features offered by CosMed. 9. OTHER FACTORS: There are no other facts to support other than full and open competition. 10. INTERESTED SOURCES: No other sources have expressed an interest in this procurement. 11. AGENCY ACTIONS TO INCREASE COMPETITION: Under the authorities and actions cited above and the fact there is no other available source, there are no actions to be taken to overcome barriers to competition. 12. CONTRACTING OFFICERS CERTIFICATION: This justification is accurate and complete to the best of the Contracting Officers knowledge and belief.
