- 17.The Directorate of Contracting (DOC), Fort Campbell, KY, has a requirement for Motorola Radio Equipment (Radios, XTS1500 13 Each; Battery, IMPRES NIMH 13 Each; Trunking 9600 BAUD 13 Each; Charger 13 Each; Nylon Case 7 Each; Headset 1 Each; Remote Speaker 6 Each; UHF Antenna 100 Each; and IMPRES Battery XTS5000 25 Each). The Government intends to enter into a firm-fixed-price contract with West Kentucky 2-Way Radio, 200 Mitch Lane, Hopkinsville, KY 42240. The procurement will be conducted on a sole source basis in accordance with the statutory authority of FAR 13.106-1(b)(1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name or industrial mobilization). The basis for restricting competition is that Motorola is the manufacturer of the equipment and has proprietary rights to the equipment and software. This radio equipment must be compatible with the existing Motorola radio trunking system. West Kentucky 2-Way Radio is Motorolas local authorized service provider for the Motorola trunking system and radio equipment and will perform the required programming of the radios upon receipt from the factory. NAICS code for this procurement is 334220 and the small business size standard is 750 employees. This sole source requirement will be procured under Simplified Acquisition Procedures and Other Than Full and Open Competition, and awarded on an unrestricted basis. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE OFFERS and solicitation will not be issued; however, any firm that believes it can meet the requirements may give written notification to the Contracting Officer within 10 days from the date of the publication of this synopsis. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements listed. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion for the Government. If no responses are received, the Government will proceed with the sole source negotiation with Motorola Corporation. Responses are due by 5 August 2009, 3:00 P.M. (CST).
