- The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Biokinetics and Associates, of Ottowa, Canada for the purchase of a Ballistic Load Sensing Headform System under other than full and open competition by the authority of FAR subpart 13.106 b(1): Only one responsible source and no other supplies or services will satisfy agency requirements. The office of Law Enforcement Standards (OLES) at the National Institute of Standards and Technology is conducting research to support the development of a performance standard for Ballistic Helmets. Over the past ten years, significant fundamental research has been conducted by the U.S. Army, the University of Virginia, Defence Research and Development of Canada, and Biokinetics and Associates, Ltd. to develop an instrumented headform to which a ballistic helmet can be attached for the purpose of evaluating the protection afforded by the helmet. NIST-OLES’s objective in testing these headforms is to use the data to develop standards for personal protective equipment used by law enforcement officers. NIST is conducting research collaborations with both the U.S. Army and the Canadian Standards Association that require that NIST obtain identical Biokinetics headforms for the purpose of correlating its test results with those obtained by these other agencies. Biokinetics and Associates, Ltd. is the only manufacturer and distributor for the required Ballistic Load Sensing Headform System, and no other suppliers can satisfy NIST’s requirements. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor’s commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 334519, and the size standard is $4.5M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 3:00 p.m. (EST) on August 14, 2009. Inquiries will only be accepted via email to paula.wilkison@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
