- Question 4: The lighting units will be assembled by a HUB Zone certified sub-contractor. Is this equivalent to being manufactured by a HUB Zone certified sub-contractor? Not all of the components of the lighting units are manufactured in HUB Zone(s) in the United States and the fixtures are not all assembled by and in HUB Zones in the United States. Consequently assembly by a HUB should be important. Government Response: All "Bidders" must be "Hub Zone Certified." Award will be made to a responsive and responsible certified Hub Zone firm (Low Bidder). All Hub Zone (Prime Contractor) "Sub-Contractors" (Manufactures) do not have to be a certified Hub Zone firm. Construction materials requirements; all Bidders must comply with FAR 52.225-9, FAR 52.225-10, FAR 52.225-11 (Alt I), and FAR 52.225-13. The Awardee (Hub Zone firm) does not have to assembly the potential "sub-contractors" materials. Question 5: Should proof/validation/confirmation of HUB Zone certification be submitted with the bid package? i.e. State HUB Certificate and Identification Number? Government Response: "Should" - After Bids are received, we will validate Hub Zone certification and responsibility in accordance FAR 19.13 Historically Underutilized Business Zone (HUBZONE) Program, and FAR 9.102 Applicability. Question 6: As the prime we are CCR and ORCA registered, small and minority owned, but we are not a HUB Zone contractor. We have a joint venture/teaming agreement with a HUB Zone certified contractor who will be assembling and installing the units. Does this meet the requirements of the bid process? Government Response: "No" - Only the certified Hub Zone firm can submit a bid. You can be the Bidder's sub-contractor. Question 7: Does the subcontractor on this project have to be CCR/ORCA registered? Government Response: "No" - With the understanding that the Prime Contractor (Bidder) and their sub-contractors are not on the Debarment Listing. Please refer to FAR 9.403: Excluded Parties List System, and FAR 52.209-6, Protecting the Government's Interest when Subcontracting with Contractors Debarred, Suspended, or Proposed for Debarment. Question 8: Is a letter of credit from a Surety Company stating it will provide the necessary Performance and Payment Bonds upon request meet or exceed the Bonding requirement for the bid? Government Response: "No" An original "Bid Guarantee" Bond (20% of the Bid) must be submitted with the Bid package. If not received, Bidder will be "non-responsive" (bid will not evaluated). Reminder, Payment and Performance Bonds are required after award prior to issuance of a Notice to Proceed (NTP) of work.
