- The Department of Commerce, National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Northeast Region, Gloucester, MA is issuing an intent to negotiate a sole source procurement with the Maine Department of Marine Resources to expand its existing project and provide NOAA with a full report and present the data at the Right Whale Consortium meeting in November of 2009 and the Atlantic Large Whale Take Reduction Team. Section 109(h) of the Marine Mammal Protection Act (MMPA) allows state agencies to act as independent in the stewardship and conservation of marine mammal species. As such, The State of Maine has the authority to act on the behalf of NMFS regarding gall marine mammals issues as they pertain to their state jurisdiction. The state of Maine is the only active marine mammal stranding responder in southern and mid-coast Maine. They are uniquely qualified to perform this role based on their experience and authority authorized under MMPA Additionally, no other institution has the data resources to undertake this work. The statutory authority for other than full and open competition is 41 USC 253 (C)(1), Only One Responsible Source. The applicable NAICS code is 114119. The planned period of performance is one year from the award date. Interested parties may identify their interest and must provide evidence of their capability to respond to this requirement by August 30 th at 1PM.. Responses to this notice, if any, must show clear and convincing evidence that competition would be advantageous to the government. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
