- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. The Department of State Office of Acquisition Management (A/LM/AQM) is conducting this acquisition for TEMPEST Switches and Cables on behalf of the requesting bureau. The estimated cost is $106,000.00. 2. Nature and/or description of the action being approved: New Purchase Order for commercial items – TEMPEST Switches and Cables, for use on the Department’s Classified network. This procurement is being conducted under FAR 13.5 – Test Program for Certain Commercial Items. 3. A description of the supplies or services required to meet the Department’s needs: The Department has a requirement for a switch which allows for connectivity on both the OpenNet and ClassNet systems. The nomenclature for the requisite unit and associated cabling is as follows: --YT1- SWITCH HI3 / HISOLATOR 3-PORT KVM SWITCH WITHOUT SWAP SYNC --YZU-HI-CBL-13/ SONE 13" HISOLATOR PS2 CABLE --YT1-HTRA-KVM-CBL-13/SWITCHED PERIPHERAL PORT GROUP CABLE, HTRA PC. 4. An identification of the statutory authority permitting other than full and open competition: 41 USC 253(g) and FAR 13.501, Only One Responsible Source 5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited: In accordance with National Security protocol and requirements, Department of State IRM/OPS/ITI/TSS, and DS/CMP require all equipment being used on the Department’s Classified network and in the CAA overseas to meet certain security and electronic emissions specifications and pass associated testing. Once tested, upon approval by the Department’s Certified TEMPEST Technical Authority (CTTA), items are then approved for purchase and use. The only TEMPEST KVM switches that have been submitted for testing and are approved for use by the Department's CTTA are items from the TEMPEST vendor Advanced Programs, Inc (API), and include the specific items being requested in this requirement. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: This Justification will be publicized on FedBizOpps, in accordance with FAR 5.2. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The Contracting Officer will make a fair and reasonable price determination in accordance with FAR 13.106-3, and will be based on Market research, comparison of previous purchase prices found reasonable, or a comparison with similar items in related industry. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. The Department’s Classified Equipment CTTA-Approved Equipment List (AEL) was reviewed for potential alternates. The API products are the only TEMPEST KVM switches that have been submitted for testing and approved by the CTTA. 9. Any other facts supporting the use of other than full and open competition. N/A 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. N/A 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: This Justification will be publicized on FedBizOpps, in accordance with FAR 5.2. However, acquisitions conducted under simplified acquisition procedures are exempt from the requirements in Part 6. Several DOS Program Offices are currently soliciting new products from multiple TEMPEST certified equipment manufacturers to amend, augment, and/or revise the AEL. This process is ongoing and continually offers other vendors the opportunity to submit products for addition to the AEL. There are no additional items currently pending AEL approval that would have an effect on this J&A or competition for this requirement.
