- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION I. Contracting Organization: DLA-OGDENIDSCR-ZAD Contracting Officer: Mike Gribble DSN: 777-5813 6050 Gum Lane, Bldg 1215 Hill AFB, Utah 84056-5825 Purchase Request: FD2020-09-90355 II. Description of Action: A. The United States Air Force will issue a new contract for the procurement of three replenishment spares of the Row Power Supply, NSN 6130-01-466-0637QX, PIN 7280430G2, from Lockheed Martin, DBA: Lockheed Martin Corp, Maritime Systems, Electronics Parkway Bldg 7, MD 3, P.O. Box 4840, Syracuse, I y, 1322-4840, CAGE Code: 03538. The items for purchase are used on the equipment installed on the ANIFPS-117 Long Range Radar that supports the Atmospheric Early Warning Systems (AEWS) program. B. Contemplated Contract Type: Firm-Fixed Price (FFP). C. Type J&A: Individual III. Description of Supplies/Services: A. The Row Power Supply is part of the ANIFPS-II7 Long Range Radar, a system under the Atmospheric Early Warning Systems(AEWS) program. The radar uses eight of the Row Power Supplies to power the transmitters and receiveFs throughout the array. The Row Power Supply receives digital control signals and 208 VAC three-phase power and outputs regulated 28 VDC power, unregulated -60 VDC power, and a digital error signal. B. Quantity: 3 EA. Total Estimated Cost: This is based on recent market research information from a prior contract. This is for a Foreign Military Sales (FMS) appropriation. 6130-01-466-0637QX 7280430G2 NOUN Power Supply 3 UNIT COST IV. Statutory Authoritv: 10USC 2304(c)(I), as implemented by FAR 6.302-1. Only One Responsible Source V. Applicabilitv of Authoritv: A. The above authority was selected because the Government lacks test procedures and has only limited use of the technical data on the Row Power Supply. Due to proprietary rights, the Government lacks authority to release the technical data necessary to build this power supply. Lockheed Martin, the original equipment manufacturer (OEM), owns the necessary data, technical expertise, test procedures and processes that can insure this power supply is properly manufactured in accordance with existing specifications. Lockheed Martin is the only known source that owns the data required to insure this asset is built and tested to Government specifications. B. The Row Power Supply is part of the AN/FPS-117 Long Range Radar. Specific technical data and expertise is required to manufacture and test this power supply. The Government does not have required test procedures nor the auihority to release the data package that is necessary to produce this power supply. It is not within the Government's capability io manufacture the Row Power Supply. C. Budget constraints have caused reprocurement data purchases to be deferred. It has also been determined that the cost to purchase reprocuremeni data would exceed the projected savings over the lifespan of the part. For these reasons, it has been determined that it is not in the best interest of the Government to acquire or otherwise develop additional data at this time for post production support. Therefore, the Government is authorized and intends to use other than full & open competition procedures to acquire the replenishment spares of the radar receiver in support of the radar. VI. Efforts to Obtaiu Competition: This action will be synopsized in FedBizOpps as a notice of contract action IAW FAR 5.201. If other sources express interest as a result of this synopsis or other action, they will be listed in the official contract file. VII. Fair aud Reasonable Costs: The cost of this acquisition will be fair and reasonable. Actions anticipated to ensure reasonableness of the price will be accomplished in accordance with the procedures and criteria contained in the FAR under Parts 30 - Cost Accounting Standards, and 31 - Contract Cost Principles and Procedures, and Subpart 15.4 - Contract Pricing, as appropriate. Further actions will be under the guidance of the Pricing Reference Guide, dated May 96. Detailed documentation and justification or price reasonableness will be disclosed in the official Price Negotiation Memorandum, to be prepared upon completion of negotiations. Government personnel with experience in contracting for similar services will fact fmd and negotiate this effort. VIII. Market Research: A. Market rp. The team determined that Lockheed Martin, OEM, is the only company able to manufacture this power supply to Government specifications. B. This determination was a result of recently conducted market research which consisted of reviewing past contracts, analyzing available data, and doing internet searches of Government databases for companies that manufacture various radar equipment. The companies identified did not possess the necessary data, technical expertise, equipment and processes to manufacture the Row Power Supply. Lockheed Martin is the only known source possessing the comprehensive capability to meet the Government requirements. As a result of the market research, it has been determined that there are no additional qualified sources in the commercial marketplace. IX. Other Facts: None. X. Interested Sources: None. XI. Steps to Foster Competition: The Government does not have sufficient data or rights in the data that can be provided to allow for competition of this requirement. No other sources have expressed interest in competing for this effort. If the buyer discovers information to the contrary, it will be listed in the contract file. XII. TecbnicaI!Reguirements Personnel's Certification: As evidenced by their signatures on the Coordination and Approval Document (CAD), the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete. XIII. Contracting Officer's Certification: The Contracting Officer's signature on the CAD evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief.
