- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a request for proposal (RFP). The solicitation document incorporated provisions and clauses in effect through Federal Acquisition Circular 2005-36. Applicable North American Industry Classification Standard (NAICS) code is 519130, size standard of 500 employees. The contract will be awarded using simplified acquisition procedures in accordance with FAR Part 13. The acquisition is for the purchase of Legislative Tracking System IAW with SOW at the US Department of Labor in Washington, DC. See Scope of Work below: 52.232-18 Availability of Funds (Apr 1984) Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. I. SCOPE OF WORK The act of publishing the article is a year-long process. Information is obtained from a contractor on a daily basis early each workday morning. Two types of information are critical: (i) legislative reports; and (ii) regulatory reports. (i) Legislative Reports: The first legislative report will be a listing of bills introduced by all 50 states in the previous 24 hours along with a summary of each piece of legislation. This legislation listing will need to customizable by the WHD to meet the search parameters established by this agency. Even with the search parameters set at the WHD requirements, the listing and summaries total are expected to reach 5,000 to 7,500 per year. Each legislative item and summary on the list is then reviewed and analyzed by WHD staff to determine if the item falls into one of more than 30 labor legislation categories that are tracked by this Division. Those pieces of legislation that fall within the 30-plus categories are entered by WHD staff into a separate database that will be maintained by the Contractor. This information (throughout the entire legislative process) must be updated daily by the Contractor for WHD review. The second legislative report required by the WHD is a listing of legislation enacted by states in the previous 24 hours along with a summary of each piece of legislation. This information is also analyzed on a daily basis by WHD staff. The report also serves as a backup for the first report and is necessary because legislation may be amended after introduction and before enactment, thus changing the information provided in the initial summary and resulting in a different determination by WHD as a result of its further review and analysis. Upon determination that the enacted legislation is appropriate for WHD’s purposes, each piece is written up and made ready for inclusion in the Monthly Labor Review publication. (ii) Regulatory Reports: WHD has determined based upon its experience that the portfolio of changes to state labor requirements it has been obtaining from the legislative reports is not sufficient or complete. WHD has decided to add services that encompass regulatory elements. This additional service, also covering the jurisdictions of the 50 States and the District of Columbia, will provide the following capabilities and elements: (1) full text search and retrieval, (2) topic searching, (3) summaries and status, (4) private files (includes customized headings, tags, and commentary, and a (4) calendar of agency hearings. II. PERFORMANCE REQUIREMENTS Services include and are closely related to the following: •One interface that incorporates all services; •Five (5) log user log-ins; •Customer service available 24 hours a day, seven days a week. DELIVERABLES •Daily reports listing all introduced legislation, changing status and location; •Daily reports listing all enacted legislation and enactment date; •A summary of all introduced legislation; •A summary of all enacted legislation; •A separate file, maintained by the contractor, of all WHD data files; •A contractor report listing possible upcoming legislation on “hot issues” as discussed by state legislatures and/or governors; •Special reports provided upon WHD request. V. ADDITIONAL INSTRUCTIONS AND SPECIAL CONSIDERATIONS 1.Period of Performance: The duration of this Task Order will be for twelve (12) months from the date of award, October 1, 2009 through September 30, 2010, with four option years ending September 30, 2014, unless terminated sooner by the issuance of a task closure memorandum by the Contracting Officer. 2.Identification of Possible Follow-on Work: This Task Order has four (1) year options that may be exercised each year, depending upon WHD needs and the Contractor’s successful completion of the original period of performance. 3.Place of Performance: Not Applicable 4.Travel: Not Applicable 5.Government Furnished Equipment/Items/Support: Not Applicable 6.Security: Not Applicable Invoicing: Invoices will be submitted to the COTR on a monthly basis.
