- The National Cancer Institute (NCI), Radiation Oncology Branch (ROB), Center for Cancer Research (CCR) plans to procure on a sole source, an XKnife workstation upgrade, BRW ring assembly and LTLF laser target localizer frame from Integra Radionics Inc.; 22 Terry Avenue; Burlington, MA 01803-2516. This acquisition will be conducted under the authority to use simplified acquisition procedures in accordance with FAR 13.106-1(b)(1). The North American Industry Classification System code is 334516 and the business size standard is 500 employees Delivery Date: 90 days from date of award. This notice is not a request for competitive quotation. However, if any interested party believes it can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities and any other information furnished must be in writing and must contain material in sufficient detail to allow NCI to determine if the party can perform the requirement. No faxed or emailed capability statements will be accepted. Contractor shall provide one (1) original and one (1) copy of the capability statement. Capability statements must be received in the contracting office by 11:00 AM EST, by August 28, 2009. All questions must be in writing and can be faxed or emailed to: Ashley Virts, Contract Specialist via electronic mail at virtsa@.mail.nih.gov or fax to 301-402-4513. It is the vendors' responsibility to ensure all questions have been received in the contracting office. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No collect calls will be accepted. In order to receive an award, contractors must be registered and have valid certification in the Central Contractor Registration (CCR) and the Online Representations and Certifications Applications (ORCA). Reference: NCI-90210-AV on all correspondence. Part I: Background information and description of requirements: The Radiation Oncology Branch treats cancer patients with radiation according to approved clinical protocols. Two of the treatment modalities offered by ROB are stereotactic radiosurgery (SRS) and stereotactic radiotherapy (SRT). Both of these modalities require specialized hardware and treatment planning software in order to deliver precise treatments with sub-millimeter accuracy. The ROB previously purchased such a system from Integra Radionics in 1998 and has successfully employed it in SRS and SRT for over 10 years. Both SRS and SRT are extremely labor intensive treatment modalities. A recent increase in the number of such cases referred to ROB has taxed the available resources which can be committed. In order to accommodate this increase with the existing manpower, the Branch needs to enhance its efficiency by upgrading the treatment planning capability. Additional hardware must also be purchased in order to treat multiple cases per day and multiple sites per patient, so as to optimally utilize departmental resources. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION: Part II: Facts and Reasons to Justify Other than Full and Open Competition: Statutory Authority 1 Statute: This justification has been prepared under simplified acquisition procedures as set forth in 13.106-1 (b)(1). 2 Justification: Integra Radionics is the manufacturer and sole distributor of the XKnife Radiosurgery System. All system components are classified as Medical Devices by the FDA and have survived a rigorous and expensive approval process. Components from similar systems offered by competing vendors are incompatible with the XKnife system due to proprietary hardware and software protected by patents. Additionally, Integra Radionics has the sole pool of trained technicians and fabrication facilities to service repair and replace components of the system. ROB has an existing service contract with Integra Radionics to perform periodic preventive maintenance inspections, repair or replace defective components and provide software updates to enhance treatment planning. The terms of this contract permit Integra Radionics to offer certain upgrades (workstation) at a substantial discount because the upgrade is required for future software releases. The substitution of third-party components for the requested items would both void the terms of the existing service contract and constitute an unacceptable modification of an approved medical device according to the FDA. For these reasons, no other source is known to the NCI to provide the supplies for the lab.
