- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1.The Office of Acquisition Management (A/LM/AQM) is conducting this acquisition for TEMPEST Laptops and Copiers on behalf of Information Resource Management, Lan and Wan Services (IRM/OPS/ITI/LWS/ITL). 2. Nature and/or description of the action being approved: New Purchase Order for commercial items – TEMPEST laptops and copiers, for use on the Department’s Classified network. This procurement is being conducted under FAR 13.5 – Test Program for Certain Commercial Items. 3. A description of the supplies or services required to meet the Department’s needs: The Department has a requirement for Tempest Laptops and Copiers to be used on the Department’s Classified network. The required specifications are as follows: Laptop: YT1-MWS5-FSA2/TEMPEST D810, P-M770 (2.13GHZ) ATI X 600 W/128MB VID, 512MB. Includes: YT1-CDRW/DVD-MW5/READ/WRITE CD/DVDROM DRIVE YT1-KB-MW5-US/WINDOWS95 KEYBOARD USB UNITED STATES YT1-MW5-XP/MWS5, 40GB XP DRIVE, MOUSE w/ YCS-ACADAPT-MW5/ AC ADAPTER, DELL LATITUDE (MW5) Copier: YT1-AR168-110V-PK2/TEMPEST SHARP AR-168D DIGITAL COPIER 110V 16PPM MFP, 2-250 SHEET PAPER TRAYS, NETWORK EXPANSIONKIT WITH 256MB MEMORY UPGRADE, PS LEVEL 3 KIT PCL6 NETWORK PRINTING/NETOWKR SCANNING EXPANSION KIT 256MB MEMORY UPGRADE FOR AR-NB2N (REQU IRED FOR COLOR SCANNING); 1 TONER PACK; 1 DEVELOPER PACK; UNITED STATES POWER PLUG; w/ YCS-AR168-110V-CONSUMABLES for AR-168D Includes: TONER/ DEVELOPER KIT; DRUM UNIT. w/ YCS-AR168-110V-SPARES-KIT for AR-168D Includes: FUSER UNIT; PAPER FEEDERS – RUBBER; DC POWER SUPPLY 220V; HI VOLTAGE POWER SUPPLY. 4. An identification of the statutory authority permitting other than full and open competition: 41 USC 253(g) and FAR 13.501, Only One Responsible Source 5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited: In accordance with National Security protocol and requirements, IRM/OPS/ITI/TSS, and DS/CMP require all equipment being used on the Department’s Classified network and in the CAA overseas to meet certain security and electronic emissions specifications and pass associated testing. Once tested, upon approval by the Department’s Certified TEMPEST Technical Authority (CTTA), the items are added to the Approved Equipment List (AEL) and are then approved for purchase and use. The only Laptops and 16PPM Multifunction Copiers that are on the Department’s current Approved Equipment List (AEL) dated February 2009 are items from the TEMPEST vendor Advanced Programs Inc (API), and include the specific items being requested in this requirement. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: This Justification will be publicized on FedBizOpps, in accordance with FAR 5.2. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The Contracting Officer will make a fair and reasonable price determination in accordance with FAR 13.106-3, and will be based on Market research, comparison of previous purchase prices found reasonable, or a comparison with similar items in related industry. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. The Department’s Classified Equipment Approved Equipment List was reviewed for potential alternates. The API products are the only Laptops and 16PPM Multifunction Copiers on the AEL. 9. Any other facts supporting the use of other than full and open competition. N/A 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. N/A 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.) This Justification will be publicized on FedBizOpps, in accordance with FAR 5.2. However, acquisitions conducted under simplified acquisition procedures are exempt from the requirements in Part 6. Several DOS Program Offices are currently soliciting new products from multiple TEMPEST certified equipment manufacturers to amend, augment, and/or revise the AEL. This process is ongoing and continually offers other vendors the opportunity to submit products for addition to the AEL. There are no additional items currently pending AEL approval that would have an effect on this J&A or competition for this requirement.
