- The Marine Corps Systems Command (MCSC), PG-13 Infantry Weapons Systems (IWS), PM-135, Optics and Non-Lethal Systems (ONS) 2200 Lester St, Quantico VA 22134 intends to negotiate and award a follow-on contract to an Urgent Universal Need Statement (UUNS) procurement (contract number M67854-06-C-1001) on a sole source basis with Combined Systems, Inc. (CSI) of Jamestown, PA for a quantity of 225 each of NL/TLMS system and munitions with an approximate dollar value of $17,000,000.00 in accordance with (IAW) FAR 6.302-1 (a) (2), "Only One responsible source and no other supplies or services will satisfy agency requirements." The NL/TLMS, which was designed and developed by CSI, is a 40 mm, three bank launching system that fires 30 rounds of non-lethal primed munitions. The NL/TLMS will provide the Marine Expeditionary Forces the ability to deliver a high volume of non-lethal fire at designated ranges, both day and night, to enhance force protection at Vehicle Check Points (VCP) and during convoy security operations. The Government does not have any intellectual property rights in the NL/TLMS, or a technical data package that would permit the procurement of the NL/TLMS through full and open competition. Award to another source would require it to duplicate the engineering details of the NL/TLMS, which in turn would result in unacceptable delays in fulfilling the agency's requirement. Furthermore, award to another source would result in additional unacceptable delays associated with testing and certification, which is required to be performed prior to the fielding and deployment of any other NL/TMS system. Approximate award date is February 2010. This is not a formal solicitation; furthermore, this synopsis is not considered a Request for Quotation or Proposal. No solicitation document is available and telephone requests will not be honored. No contract will be awarded on the basis of offers received in response to this notice. Any responsible source that possesses the capability to provide the NL/TMS as described above may submit a capability statement which shall be considered by the agency. If no affirmative written response is received, the purchase will be awarded without further notice. A determination by the Government not to compete this proposed contract based on this notice is solely within the discretion of the Government.
