Description
General Services Administration Findings and Determination for Other than Full and Open Competition PROPOSED ACTION: The General Services Administration (GSA) proposes to enter into a lease extension for a period of four years retroactive to February 13, 2008 to continue to house the Department of Homeland Security (DHS) which includes Immigration Customs Enforcement (ICE), Citizenship Immigration Service (CIS) and Transportation Security Administration (TSA) located at the Nisky Center, St. Thomas, Virgin Islands. The contract rent for this lease extension is expected to be approximately an annual rental rate of $889,364.00 or $46.00/rsf for an aggregate rent of $3,557,456.00 for the four year lease term less the aggregate rental which GSA has continued to pay under the expired lease. The Government will have cancellation rights after thirty days (30) prior written notice to the Lessor at any time during the lease term. DESCRIPTION OF REQUIREMENT: The current lease expired on February 12, 2008 with no further renewal options. At this time the Lessor offered GSA an option to extend two or four years with an increase in rent. GSA then worked with all three tenant agencies to obtain approval of a lease extension for a two or four year period. All three agencies were not able to agree to the terms and delayed on the approvals to continue to move forward with the lease extensions. Therefore GSA continues to pay rent on a month to month holdover situation until a new lease extension is signed with the Lessor. As a result, a four year lease extension is being sought, with cancellation rights after 30 days prior written notification. This will insure that the Government has sufficient time to conduct a competitive procurement and relocate ICE into their new building. An extension of this lease will be retroactive to February 13, 2008. ICE, CIS and TSA currently occupy a total of approximately 19,334 /rsf or16,423/usf of office and related space under Lease No. GS-02B-18984. The annual rental rate being paid is $38.21 per annum or $738,799.64 /per annum. DHS/ICE has decided to relocate into a DHS owned building and will not require GSA to do a new competitive procurement, but GSA will need to protect occupancy until the new facilities are completed. GSA has not received space requirements from TSA and CIS. TSA and CIS have also expressed a desire to separate the two units and to relocate the two Divisions to a new location that can provide better security and accommodations covering their operational needs on the Island. At this moment our Regional Account managers are working with both agencies (TSA and CIS) to obtain requirements to start a competitive lease acquisition. Allowing the DHS to continue at their current location will allow the agency to continue providing their services and investigations without interruptions. UNIQUE QUALIFICATIONS: The current space has alterations and costly installations, including special, security installations; data and telephone connections and has recently completed alterations within their area that only meet CIS operational requirements that allow them to carry out their current mission assignments and better serve their customers. EFFORTS TO ENSURE SOLICITATION FROM MAXIMUM SOURCES PRACTICAL: N/A DESCRIPTION OF MARKET SURVEY REPORT - See attached market survey summary report. DETERMINATION THAT ANTICIPATED COSTS WILL BE FAIR AND REASONABLE: The anticipated annual rental rate is considered fair and reasonable based on the availability of leased space in the St. Thomas Virgin Islands area and the Realty Specialist's knowledge of the rental rates in this market for office space. The attached market survey summary report (Schedule A) includes comparables representing good quality, modern office space in this market. The comparables show market data in the St. Thomas area ranging from net $30.00/rsf to $37.00/rsf for shell rate plus approximately $12.00/rsf for operating services. As a result, the estimated range for fully serviced rental rates would be approximately $42.00/rsf to $49.00/rsf under a new lease in this rental market. No tenant improvement costs have been added as DHS does not require any alterations performed under the lease extension period. The proposed rental rate of $42.00/rsf for a fully serviced lease without tenant improvements is within the current rental rates and is considered to be fair and reasonable. OTHER FACTORS SUPPORTING JUSTIFICATION: N/A LIST OF SOURCES EXPRESSING INTEREST IN SOLICITATION: NONE FUTURE ACTIONS TO OVERCOME BARRIERS TO FULL AND OPEN COMPETITION: A fully competitive lease acquisition procurement action will be initiated upon receipt of the agencies space requirements.
